How many days of absence are allowed for lower and upper secondary school students before being subject to grade retention in Vietnam?

Based on Article 12 of Circular 22/2021/TT-BGDDT:

Promoted, Re-evaluated During Summer Break, Not Promoted

1. Students who meet the following conditions are eligible for promotion or recognized as completing lower secondary or upper secondary education programs:

a) Annual behavior performance (including re-evaluation after retraining during the summer break as stipulated in Article 13 of this Circular) is rated as Pass or higher.

b) Annual academic performance (including re-evaluation of subjects as stipulated in Article 14 of this Circular) is rated as Pass or higher.

c) Not exceeding 45 days of absence in one academic year (calculated based on the educational plan of 1 session/day prescribed in the General Education Program, including excused and unexcused absences, consecutive or non-consecutive absences).

2. For students requiring retraining during the summer break, it is to be conducted as stipulated in Article 13 of this Circular; students needing re-evaluation of subjects during the summer break will follow the regulations in Article 14 of this Circular.

3. Students who do not meet the requirements of Clause 1 of this Article will not be promoted or recognized as having completed the lower secondary or upper secondary education programs.

4. For students with disabilities: The principal shall base on the evaluation results of students with disabilities as stipulated in Article 11 of this Circular to consider promoting or recognizing the completion of the lower secondary or upper secondary education programs for students with disabilities.

Thus, lower and upper secondary school students who have more than 45 days of absence in one academic year (calculated based on the educational plan of 1 session/day prescribed in the General Education Program, including excused and unexcused absences, consecutive or non-consecutive absences) will have to repeat the class.

What are the responsibilities of lower and upper secondary school students in Vietnam?

Based on Article 34 of the Regulations for Lower Secondary, Upper Secondary, and Common Schools issued together with Circular 32/2020/TT-BGDDT, the responsibilities of lower and upper secondary school students in Vietnam are as follows:

- Fulfill learning and training tasks according to the school’s educational program and plan.

- Respect parents, school officials, teachers, staff, and the elderly; unite and assist each other in learning and training; comply with the school charter and regulations; follow the laws of the State.

- Exercise and maintain personal hygiene.

- Participate in collective activities of the school, class, Ho Chi Minh Young Pioneer Organization, Ho Chi Minh Communist Youth Union; help the family, engage in labor and social activities, environmental protection activities, and comply with traffic safety orders.

- Preserve and protect the school's property and public places; contribute to building, protecting, and promoting the school's traditions.

What are the rights of lower and upper secondary school students in Vietnam?

Based on Article 35 of the Regulations for Lower Secondary, Upper Secondary, and Common Schools issued together with Circular 32/2020/TT-BGDDT, the rights of lower and upper secondary school students are as follows:

- Equal enjoyment of comprehensive education, assured conditions of time, facilities, hygiene, and safety for studying in class and self-study at home, informed about their learning and training, use of equipment, and facilities for educational, cultural, and sports activities according to regulations.

- Be respected and protected, treated equally and democratically; have the right to complain to the school and education management levels about decisions affecting themselves; transfer schools if justified under current regulations; study ahead of age, skip grades, study at an age higher than the prescribed age as per Article 33 of the Regulations issued with Circular 32/2020/TT-BGDDT.

- Participate in activities to develop talents in subjects, sports, arts organized by the school if qualified.

- Receive scholarships or other allowances as stipulated for students entitled to social policies, students in difficult life situations, and students with special abilities.

- Transfer schools if meeting required conditions; the transfer procedures follow the current regulations of the Minister of Education and Training.

- Enjoy other rights as prescribed by law.
