How to name private preschools correctly in Vietnam?
Pursuant to Article 5 of the preschool Charter, issued with Circular 52/2020/TT-BGDDT, the naming of preschools are stipulated as follows:
1. Naming the School
- The school's name comprises: preschool (or Preschool or Nursery) and the school's specific name. The school's name is recorded in the establishment decision, seal, signboard, and transaction documents.
- The specific name of the school must be clear, transparent, not misleading about the organization's operation; consistent with national history, culture, ethics, and traditional customs, and compliant with intellectual property regulations.
2. The School’s Signboard
- Top Left Corner:
+ First line: District-level People’s Committee and the name of the district-level unit;
+ Second line: Department of Education and Training.
- Center: The school's name as prescribed in Clause 1 of this Article. If using a foreign name, it must be placed below the Vietnamese name with a smaller font size. For school branches, the branch name is placed below the main school name.
- Bottom Left Corner: Address, phone number, website (if any), email address, establishment decision number or permit.
Are Private preschools allowed to be Funded by Foreign Investments in Vietnam?
Pursuant to Article 4 of the preschool Charter, issued with Circular 52/2020/TT-BGDDT, the following types of preschools are defined:
Types of preschools
1. Public preschools funded by the State, ensuring operational conditions and representing the owner's rights.
2. Non-public preschools funded and ensured operational conditions by the local residential community, including organizations and individuals in hamlets, villages, wards, or commune-level towns.
3. Private preschools funded by domestic or foreign investors who ensure operational conditions.
As per the above regulation, private preschools can be funded and ensured operational conditions by foreign investors.

What Qualifications are Needed to Open a Private preschool in Vietnam?
* Preschool:
Pursuant to Article 26 of the Education Law 2019, preschools are the general term referring to preschool educational institutions, including:
- Nursery, independent nursery groups accepting children from 03 months to 03 years old
- Preschool, independent preschool classes accepting children from 03 to 06 years old
- Preschool, independent preschool classes combining nursery and preschool, accepting children from 03 months to 06 years old.
Accordingly, the structure and organization of independent nursery groups with more than 07 children, independent preschool classes, and independent preschool classes include: the principal; specialized managers; teachers, staff (if any), and groups of children, preschool classes. (Article 10 of the Regulations on the Organization and Operation of Independent Nursery Groups, Independent Preschool Classes, and Independent preschool Classes of Non-Public Institutions issued pursuant to Circular 49/2021/TT-BGDDT)

Pursuant to Article 11 of the Regulations on the Organization and Operation of Independent Nursery Groups, Independent Preschool Classes, and Independent preschool Classes of Non-Public Institutions issued with Circular 49/2021/TT-BGDDT, the principal is an individual or an individual representing an organization that applies for permission to establish an independent preschool educational institution.
(1) Standards for the Principal of a Preschool Educational Institution:
- Must be a citizen of the Socialist Republic of Vietnam
- Good moral character
- Under 65 years old
- Good health
- Must have a high school diploma or higher.
Additionally, according to the standards for the principal of a preschool educational institution as stipulated in Article 11 of Circular 49/2021/TT-BGDDT, the principal is not required to have a pedagogy degree.
Therefore, it can be understood that to establish a preschool, a pedagogy degree is not mandatory.
However, pursuant to Article 12 of Circular 49/2021/TT-BGDDT, the educational manager of the preschool institution must have a college degree or higher in preschool education.
- Specifically, the specialized managerial responsibilities are agreed upon in the labor contract by the principal of the independent preschool educational institution. These responsibilities can be concurrently managed by the principal, teacher, or staff if they meet the required standards.
- The educational manager has duties and authority in managing the care, education, and nurturing programs for children as stipulated in the Preschool Education Program, including:
+ Organizing the development and implementation of the care, nurturing, and educational plans for preschool children at the independent preschool institution according to the Preschool Education Program
+ Supervising and inspecting the care, nurturing, and educational activities of teachers and staff at the independent preschool institution
+ Proposing the assignment of teachers and staff in implementing professional tasks
+ Developing content and plans for professional activities; organizing professional training and guidance for teachers and staff
+ Participating in the evaluation, classification, proposing rewards, and disciplinary actions for teachers and staff as per regulations
+ Being accountable for all professional activities, records, and books for nurturing, caring, and educating children, and for implementing the Preschool Education Program
+ Self-studying, self-improving skills for professional management
+ Performing any tasks and authority agreed upon in the Labor Contract with the principal of the independent preschool institution.
Thus, it can be seen that to open a private preschool, from the qualification perspective, a high school diploma or higher is sufficient.
What are the Rights and Duties of the Principal of a Private preschool in Vietnam?
According to Clause 3 Article 11 of the Regulations on the Organization and Operation of Independent Nursery Groups, Independent Preschool Classes, and Independent preschool Classes of Non-Public Institutions issued pursuant to Circular 49/2021/TT-BGDDT, the duties and rights of the principal of a private preschool educational institution are as follows:
- Duties
+ Direct and oversee activities for nurturing, caring, and educating children
+ Treat children, teachers, and staff fairly and with respect
+ Direct and build a safe, healthy, friendly environment, and prevent violence
+ Invest in and manage facilities, equipment, toys, teaching aids, and materials for nurturing, caring, and educating children as per regulations
+ Ensure policies for teachers and staff as required
+ Ensure transparency as per the regulations.

+ Enter into employment contracts with teachers and staff as required
+ Can concurrently serve as a specialized manager, teacher, or staff if they meet the eligibility criteria
+ May negotiate tuition fees with parents or child guardians
+ Participate in political, professional, and managerial training courses
+ Enjoy policies as stipulated.
