How many days off are students in Vietnam expected to have during Lunar New Year in 2025?

The Ministry of Labor, War Invalids and Social Affairs has just sought opinions from ministries and central authorities on the plan for the 2025 Lunar New Year holiday to present to the Prime Minister of the Government of Vietnam.
According to the proposal of the Ministry of Labor, War Invalids and Social Affairs (MOLISA), Lunar New Year 2025, officials and public employees may have 9 consecutive days off.
Unlike previous years, in this draft submission, MOLISA proposes only one plan for the Lunar New Year holiday—5 days as regulated, including 2 days before the New Year and 3 days after the New Year.
The official holiday starts on Monday, January 27, 2025 up until Friday, January 31, 2025.
However, immediately preceding the official 5-day holiday are 2 weekend days, Saturday and Sunday, January 25-26, 2025.
Following the official holidays are another set of weekend days, Saturday and Sunday, February 1-2, 2025.
Therefore, in actuality, the upcoming Lunar New Year holiday will start from Saturday, January 25, 2025, and end on Sunday, February 2, 2025.
Tet holiday fully falls within 5 working days of the week, officials and public employees will have a continuous 9-day break (including 5 days of Lunar New Year and 4 weekend days).
Currently, students usually follow the vacation schedule of their teachers.
Teachers will also have 9 days off, similar to the 2025 Lunar New Year holiday schedule for students which lasts 9 days.
Additionally, as per the Academic Year Plan 2024-2025 for preschool, general education and continuing education in Ho Chi Minh City issued along with Decision 3089/QD-UBND in 2024, it is stipulated as follows:
- Public holidays regulated by the Labor Code 2019 that fall on weekends are compensated by giving the next working day off. School principals shall proactively develop a suitable education plan for their units in compliance with the regulations.
- Expected date for the 2025 high school graduation exam is on June 26 and 27, 2025.
- The Lunar New Year 2025 holiday is expected to start on January 25, 2025 (the 26th day of the 12th lunar month) and end on February 2, 2025 (the 5th day of the 1st lunar month).
The Lunar New Year 2025 holiday for students in Ho Chi Minh City may start from January 25, 2025 to February 2, 2025.
The Lunar New Year 2025 holiday for students in Ho Chi Minh City is also expected to last 9 days.

What are the rights of Elementary School Students?
According to Article 35 of the Charter of Primary Schools issued along with Circular 28/2020/TT-BGDDT, elementary school students have the following rights:
- Right to Education:
+ To be educated, to learn for overall development and to maximize their potential; to study at a school or class implementing a primary education curriculum that is convenient to their commuting needs at their place of residence.
+ Students can choose a school or transfer to another school outside their residence area if the chosen school can accommodate them.
+ Students in primary school age returning from abroad, children of foreigners studying or working in Vietnam, or children unable to attend school due to difficult circumstances, if they wish to transfer to a primary school, will be organized by the principal to assess their level for appropriate class placement.
+ Disabled students have the right to inclusive education at a primary school; they are provided the necessary conditions for learning and training; they are evaluated based on their individual educational plan.
+ Students can shorten the program duration, study at an older age, extend the study period, or repeat a class.
+ Students with good health and advanced intellectual development can skip a grade within the education levels. The procedure for consideration for each specific case is as follows:
++ Parents or guardians of the student must submit a request to the school.
++ The school principal forms an evaluation and advisory council, including the principal or vice-principal, representatives of the parents, the current class teacher, the teacher for the next grade, health staff, and the team leader.
++ Based on the evaluation results of the advisory council, the principal completes the documentation and reports to the Director of Education and Training for consideration and decision.
+ For students with limited academic performance, despite direct guidance and assistance from teachers, parents, or guardians, yet still cannot complete tasks, teachers report to the principal for consideration of class advancement or retention, and jointly with the family decide on suitable educational measures.
- Right to Protection, Care, Respect, and Equal, Democratic Treatment; to ensure legitimate rights and interests; to be fully informed about their learning and training process; to be provided with timely, clean, safe human, material, hygiene conditions for learning and training.
- Right to participate in activities that develop their personal abilities; to express personal opinions and aspirations.
- Right to receive scholarships and social policy benefits as prescribed.
- Right to enjoy other rights as prescribed by law.
What are the rights of lower and upper secondary school students in Vietnam?
The rights of lower and upper secondary school students are specified in Article 35 of the Regulations on lower and upper secondary schools, and schools with multiple educational levels issued along with Circular 32/2020/TT-BGDDT:
- Right to equality in receiving comprehensive education, to ensure conditions for time, facilities, hygiene, and safety for classroom learning and self-study at home; to be informed about their learning and training activities; to use school equipment and facilities for learning, cultural, and sports activities as regulated.
- Right to respect and protection, to equal and democratic treatment; to complain to the school and educational management levels about decisions affecting them; to transfer schools for legitimate reasons; to advance schooling years, skip grades, or study at an older age as prescribed in Article 33 of the Regulations on lower and upper secondary school, and schools with multiple educational levels issued along with Circular 32/2020/TT-BGDDT.
- Right to participate in activities developing their talents in subjects, sports, and arts organized by the school if qualified.
- Right to receive scholarships or other aid as regulated for students participating in social policies, facing life difficulties, or having special talents.
- Right to transfer schools if they meet the conditions as prescribed; the transfer procedure follows regulations of the Minister of Education and Training.
- Right to enjoy other rights as prescribed by law.
