Pursuant to Article 15 of Decree 90/2020/ND-CP as amended by Clause 4, Article 1 of Decree 48/2023/ND-CP, the criteria for rating teachers as failing to complete duties are as follows:

For teachers without managerial positions, if they meet one of the following criteria, they are rated as failing to complete duties:

- Showing signs of degradation in political ideology, ethics, lifestyle, self-evolution, self-transformation as assessed by the competent authority;

- Failing to meet over 50% of the criteria set out in the performance results based on the signed work contract, planned objectives, or assigned specific tasks in terms of progress, quality, effectiveness;

- Committing acts of violation subject to disciplinary action in the assessed year.

For teachers with managerial positions, if they meet one of the following criteria, they are rated as failing to complete duties:

- Showing signs of degradation in political ideology, ethics, lifestyle, self-evolution, self-transformation as assessed by the competent authority;

- Failing to meet over 50% of the criteria set out in the performance results based on the signed work contract, planned objectives, or assigned specific tasks in terms of progress, quality, effectiveness;

- The unit or operational field under their supervision achieving less than 50% of targets and duties;

- The unit under their direct supervision and management is involved in embezzlement, corruption, wastefulness, and subject to legal action;

- Committing acts of violation subject to disciplinary action in the assessed year.

Article 21 of Decree 90/2020/ND-CP specifies the following:

The assessment and classification results for officials and public employees serve as a basis for arrangement, utilization, education, training, promotion to higher professional ranks, planning, appointment, dismissal, transfer, rotation, secondment, rewards, discipline, assessment, and classification of party members and the implementation of other policies concerning officials and public employees.

Thus, the assessment results for teachers serve as a basis for arrangement, utilization, education, training, promotion to higher professional ranks, planning, appointment, dismissal, transfer, rotation, secondment, rewards, discipline, assessment, and classification of party members, and the implementation of other policies for teachers.

What is the Procedure for Rating Teachers Without Managerial Positions in Vietnam?

Clause 2, Article 19 of Decree 90/2020/ND-CP specifies the following:

Procedures for assessing and Classifying the Quality of Public Employees

...

  1. For public employees without managerial positions:

a) Self-assessment and classification by the public employee

The public employee prepares a self-assessment report on work results according to the assigned duties based on Form No. 03 enclosed with this Decree.

b) Assessment and assessment of the public employee

A meeting is organized at the unit where the public employee works to assess and assess the public employee.

Participants in the meeting include all public employees of the unit or all public employees of the constituent unit where the public employee works if the unit has constituent units.

The public employee presents the self-assessment report on work results at the meeting. The meeting participants provide comments, which must be recorded in the meeting minutes and approved at the meeting.

c) Consideration and decision on the assessment and classification of the public employee

The competent authority assesss and classifies the quality based on the comments at the assessment meeting specified at point b of this clause, deciding on the assessment content and classification level for the public employee.

d) The competent authority assesss and classifies the quality of the public employee, notifying them in writing and publicly within the organization, unit, or agency where the public employee works about the assessment results and classification levels; determines the form of public disclosure within the organization, unit, or agency where the public employee works, prioritizing the application of public disclosure in the electronic environment.

Thus, the procedure for rating teachers without managerial positions is carried out in 4 steps as follows:

Step 1: Teacher self-assessment and classification.

Step 2: Organize a meeting at the unit where the teacher works to assess and assess the teacher.

Step 3: Consideration and decision on the assessment and classification of the teacher.

Step 4: The competent authority assesss and classifies the quality, notifies the teacher in writing, and publicly announces the assessment results within the organization, unit, or agency where the teacher works, determining the form of public disclosure, prioritizing public disclosure in the electronic environment.
