Under Article 2 of Circular 19/2024/TT-BGDDT, the list of job positions in the education and training sector subject to periodical reassignment in Vietnam is specified as follows:

[1] Enrollment and training in public schools.

[2] Allocation of quotas and management of enrollment for educational institutions within the national education system; allocation of postgraduate training quotas and overseas training quotas at agencies and units under the management authority of local government.

[3] Appraisal and approval of training and fostering programs of educational institutions within the national education system.

[4] Appraisal of local educational materials, textbooks, teaching aids, and other technical materials supporting teaching and research.

[5] Appraisal of dossiers for the establishment and permission to operate educational institutions within the national education system under the management scope.

[6] Management of projects and proposals in the education and training sector.

[7] Allocation and appraisal of scientific research topics in the education and training sector.

Furthermore, Article 3 of Circular 19/2024/TT-BGDDT states the periodic job reassignment period as follows:

- The periodical job reassignment period in the education and training sector is from 03 (three) years to 05 (five) years.

- The job reassignment period starts from the date the decision on reassignment, arrangement, or assignment of tasks is issued by the competent authority according to legal regulations.

Thus, according to the above provision, the reassignment period for 07 job positions in the education and training sector from January 14, 2025  is from 03 (three) years to 05 (five) years.

What are the scope of regulation and regulated entities of Circular 19/2024/TT-BGDDT?

Under Article 1 of Circular 19/2024/TT-BGDDT, the scope of regulation and regulated entities of Circular 19/2024/TT-BGDDT effective from January 14, 2025 are as follows:

- This Circular stipulates the list and periodic reassignment period of job positions under management in the education and training sector at local government authorities.

- This Circular applies to officials who do not hold leading or managerial positions and public employees who directly interact with and resolve work in agencies, organizations, and units under management within the education and training sector at local government authorities.

- This Circular does not apply to vocational education.

What are the principles of periodical job reassignment in Vietnam?

Under Article 2 of Circular 27/2024/TT-BTC the principles of periodical job reassignment in Vietnam are as follows:

Principle [1]: Competent authorities will conduct periodical job reassignment for officials and public employees who do not hold leadership or managerial roles to prevent corruption.

Principle [2]: The periodical job reassignment must ensure objectivity, reasonableness, alignment with professional expertise and should not affect the activities of the unit.

Principle [3]: The periodical job reassignment must be implemented according to a plan and made public within the unit.

Principle [4]: The periodical job reassignment for officials and public employees must not be exploited for personal gain or to suppress officials and public employees.

Principle [5]: periodical job reassignment is not carried out for individuals with remaining working time of less than 18 months until retirement age.

Principle [6]: Besides adhering to the principles of this Circular, public employees must also refer to the working contracts signed with public service providers.

What are the methods of periodical job reassignment in Vietnam?

According to Article 3 of Circular 27/2024/TT-BTC, the methods of periodical job reassignment in Vietnam are as follows:

- The job reassignment is an aspect of personnel work under the leadership of the Communist Party, directly by CPV committees, and party organizations; ensuring the principle of democratic centralism, highlighting the responsibility of collective leadership and the head of the agency.

- Annually, the CPV committee and the head of the agency must issue and publicize the plan for periodical job reassignment; the plan must clearly state the purpose, requirements, specific cases requiring a reassignment, time to conduct the reassignment, rights, and obligations of individuals required to reassignment, and organizational measures for implementation.

The review and plan formulation for periodical job reassignment is carried out in the first quarter of each year.

- Job reassignment with similar expertise is conducted from one department to another within the agency; between assigned, monitored, and managed fields and localities, or between agencies within the management scope of the local government.

- For agencies with only one position in the list of periodic reassignment job positions where the position requires expertise different from other positions in the agency, the reassignment is planned by the head of the supervisory agency.
