According to Clause 3, Article 36 of the Primary School Charter issued together with Circular 28/2020/TT-BGDDT, the regulation is as follows:

3. Procedure for school transfer for primary-aged students returning from abroad.
a) Parents or guardians of students submit a request form (according to the form in Appendix II attached to this Circular) to the school receiving the transfer by direct submission, postal mail, or online submission via the public service portal (if available).
b) Within no more than 03 working days from the date of receiving the request form, the principal of the school receiving the transfer provides an opinion on the acceptance of the student in the form. In case of non-acceptance, the reason must be clearly stated in the form, and the form must be returned to the parents or guardians of the student in the manner in which the form was received.
c) In case of acceptance of the student, within no more than 07 working days from the date of receiving the request form, the primary school principal organizes an assessment of the student's competency, assigns them to an appropriate class, accepts them, and manages the student's dossier according to regulations.
The primary school principal at the school where the primary school student returns from abroad must organize a competency assessment of the student, should the acceptance be agreed upon, within no more than 07 working days from the date of receiving the school transfer request.
In addition, the principal of the school receiving the transfer must provide an opinion on the acceptance of the student in the request form. In case of non-acceptance, the reason must be clearly stated in the form, and the form must be returned to the parents or guardians of the student in the manner in which the form was received within no more than 03 working days from the date of receiving the request form.

What is the maximum age for primary school students returning from abroad?
Based on Article 33 of the Primary School Charter issued together with Circular 28/2020/TT-BGDDT stipulating the age of primary school students as follows:
Age of primary school students
- The age of students entering grade one is 06 years old, calculated according to the year. Disabled children, children with physical or intellectual developmental delays, children in areas with exceptionally difficult socio-economic conditions, ethnic minority children, orphans without care, children returning from abroad, and children of foreigners studying or working in Vietnam may enter grade one at an age higher than the prescribed age, but not exceeding 03 years. In cases where the age exceeds 03 years, the decision will be made by the head of the Department of Education and Training.
- Primary school students may study at an age older than the prescribed age in cases including students repeating a grade, students in areas with exceptionally difficult socio-economic conditions, ethnic minority students, disabled students, students with physical or intellectual developmental delays, orphans without care, students returning from abroad, and other cases as per legal regulations.
Thus, primary school students may study at an age older than the prescribed age in cases where students return from abroad. Currently, the Primary School Charter issued together with Circular 28/2020/TT-BGDDT does not specifically stipulate the maximum age for primary school students returning from abroad.
Additionally, for students entering grade 1 who are children returning from abroad or children of foreigners studying or working in Vietnam, they may enter grade one at an age higher than the prescribed age but not exceeding 03 years.
What are the responsibilities of primary school students returning from abroad when studying at a primary school in Vietnam?
Based on Article 34 of the Primary School Charter issued together with Circular 28/2020/TT-BGDDT stipulating the responsibilities of primary school students, primary school students returning from abroad have the following responsibilities when studying at a primary school:
- Study and train according to the school's educational plan and regulations; have a self-motivated attitude to study and train to fully develop virtues and capabilities as per the goals of the primary education program.
- Fully and effectively perform the tasks of studying; know how to self-study under the guidance of teachers; proactively and actively participate in experiential activities, apply learned knowledge to practical life; train physical health and maintain personal hygiene.
- Be filial to parents and grandparents; respect and be courteous to teachers, elders; show solidarity, love, and help friends, younger siblings, the elderly, the disabled, and those in difficult circumstances.
- Abide by the school regulations, protect school and public property; comply with traffic safety rules; maintain hygiene and protect the environment.
- Contribute to the activities of building, protecting, and promoting the traditions of the school and the local community.
