The process of receiving and handling essential public services "Registration for changes in the land use rights, ownership of assets attached to land due to changes in the information of the certificate holder (change of name or legal documents, personal documents, address)" based on authentication and data sharing from the national database on residents on the National Public Service Portal for two administrative procedures with the following codes: 1.004227 and 1.003877 (announced in Decision No. 1686/QD-BTNMT dated August 30, 2021, by the Minister of Natural Resources and Environment).

According to Official Dispatch 3768/BTNMT-VP 2022:

Step 1: Land user registers an account, logs in on the National Public Service Portal and performs

- Search and choose to submit a public service application: Registration for changes in the land use rights, ownership of assets attached to land due to changes in the certificate holder's information (change of name or legal documents, personal documents, address).

- Enter information in the Land and Asset Changes Registration Application (Registration Application) and verify citizen information through the National Database on Residents.

+ Case 1: If authentication is successful, save the information on the Registration Application;

+ Case 2: If authentication is unsuccessful, the system notifies the land user to update the information on the Registration Application.

- Attach the dossier: A scanned copy or photo of the issued certificate (information content must be complete, clear, and accurate as the original);

- Choose the method to send the original Certificate and receive the results of the administrative procedure through the public postal service or directly at the receiving and returning results agency;

- Choose to confirm the changes on the issued Certificate or issue a new Certificate of land use rights, house ownership, and other assets attached to the land.

- Choose to send the dossier to: Branch of the Land Registration Office / Land Registration Office (For localities where the Land Registration Office has not been established: District-level Land Use Right Registration Office) for receiving and handling the dossier.

Step 2: Receiving the Dossier

Once the registration dossier is received, the officer in charge of receiving and returning results of administrative procedures will check the dossier information and notify through the account on the National Public Service Portal, or via email, or SMS to the land user.

- Case 1: If the dossier is not satisfactory, the officer will clearly notify the reason for refusal.

- Case 2: If the dossier is incomplete or invalid, the officer sends a notice to supplement and complete the dossier as required.

- Case 3: If the dossier is complete and valid, the officer receives the dossier and sends a Receipt and Result Return Note.

For complete and valid dossiers, the receiving and returning results department will send the complete and valid dossier to the Branch of the Land Registration Office / Land Registration Office for processing.

Step 3: Processing the Dossier

- The leader of the Branch of the Land Registration Office / Land Registration Office accesses the Public Service Portal of the Ministry of Natural Resources and Environment (hereinafter referred to as the Public Service Portal) to assign the procedure for processing (Department/Division/Officer).

- The assigned officer accesses the Public Service Portal to check and compare the information in the land user’s registration dossier with the land database or the stored records at the Branch of the Land Registration Office / Land Registration Office and performs the following tasks:

+ If the information is inconsistent, inaccurate, or the land user requests verification on the Certificate but falls under the case of issuing a new Certificate (Performing cadastral parcel surveying for cases where the issued Certificate does not have a cadastral map, cadastral parcel surveying; as page 4 of the issued Certificate no longer has a blank line for confirmation of changes), then send information through the Public Service Portal to the dossier receiving and returning results department to inform the land user to complete and supplement the dossier.

\* The notification content for the land user must specify the inconsistent, inaccurate information or the reason for cadastral parcel surveying, issuing a new Certificate.

+ If the information is consistent and accurate, send the information through the Public Service Portal to the dossier receiving and returning results department to notify the land user.

\* The notification content for the land user includes: (1) The land user's registration dossier is eligible for handling; (2) Payment of fees, charges, and other costs (if any, in case of receiving results at home or receiving results through the public postal service); (3) Submission of the original Certificate (deadline, submission location); (4) Results will only be processed once the land user has fulfilled all financial obligations.

The processing officer updates the change information of the land user into the land database / Cadastral records.

- The land user pays the fees, charges, and other costs (if any) through the Public Service Portal. Submits the original Certificate directly or through the public postal service to the Branch of the Land Registration Office.

- After receiving the original Certificate from the land user, the processing officer checks the payment of fees, charges, and other costs (if any) through the Public Service Portal. If financial obligations have been fulfilled, the processing officer prepares the dossier according to regulations and performs:

+ In case of confirming changes on the Certificate: print the content to be confirmed on the Certificate for approval by the leader of the Branch of the Land Registration Office / Land Registration Office.

+ In case of issuing a new Certificate: print the new Certificate for approval by the leader of the Branch of the Land Registration Office / Land Registration Office / Department of Natural Resources and Environment according to the provincial People’s Committee decision.

+ Adjust and update changes into cadastral records and land database.

- The Branch of the Land Registration Office / Land Registration Office returns the results to the dossier receiving and returning results department.

* For localities where the Land Registration Office has not been established, the Land Use Right Registration Office at the district level performs the tasks of the Branch of the Land Registration Office / Land Registration Office mentioned above. In case of issuing a new Certificate, the district-level Land Use Right Registration Office submits it to the District People's Committee for approval.

Step 4: Returning the Results

The officer in charge of receiving and returning results of administrative procedures returns the results according to the method chosen by the land user (through the public postal service or directly at the receiving and returning results agency).
