What are the procedures for issuing procurement practice certificates in Vietnam?

The procedures for issuance of procurement practice certificates in Vietnam shall comply with Subsection 1, Section 1, Part A, Appendix II promulgated together with Decision 244/QD-BKHDT in 2019 as follows:

- Individuals wishing to be issued procurement practice certificates shall register on the National Procurement Network System.

The registration of taking the exam and the registration application on the National Procurement Network System are guided by the Procurement Management Department and posted publicly on the National Procurement Network System.

Individuals are only allowed to take the exams after successfully registering for taking the exam and fully paying the fee as prescribed.

- Individuals take the exam organized by the Ministry of Planning and Investment;

- The Ministry of Planning and Investment shall issue procurement practice certificates to those who pass the exam.

Implementation method

The issuance of practice certificates is carried out directly at the Ministry of Planning and Investment, procurement practice certificates will be sent by post, in case a candidate comes to receive it, he/she must present identification documents and sign the list.

Application

Register directly on the National Procurement Network System.

Number of application

Declare directly on the National Procurement Network System.

Deadline for settlement

Within 15 days from the date of announcement of exam results or assessment results, individuals meeting the conditions will be issued procurement practice certificates.

Results of administrative procedures

Individuals who pass the exam will be issued procurement practice certificates valid for 05 years from the date of issue.


Who will carry out the procedures for issuing procurement practice certificates in Vietnam?

Pursuant to Subsection 1, Section 1, Part A, Appendix II promulgated together with Decision 244/QD-BKHDT in 2019, persons carrying out procedures for the issuance of procurement practice certificates in Vietnam include:

- Individuals working at procurement consulting enterprises or procurement consulting units; individuals acting as independent consultants on procurement;

- Individuals working at professional project management boards: are specialized project management boards, regional project management boards as prescribed by the law on construction, or project management boards established to perform professional project management, managing multiple projects or successive projects at the same time, Head to head, project after project;

- Individuals working at specialized centralized procurement units: units established to carry out centralized procurement and procurement activities on a regular and continuous basis;

- Other individuals in need.

Accordingly, the above-mentioned subjects must fully meet the conditions for being issued procurement practice certificates according to Clause 2, Article 111 of Decree 63/2014/ND-CP, Article 12 of Circular 04/2019/TT-BKHDT as follows:

(1) Have the certificate of basic training in procurement

(2) Obtain at least a bachelor’s degree;

(3) Have full legal capacity and is not incurring criminal prosecution;

(4) Satisfy one of the following conditions:

- He/she has regularly and continuously engaged in one of the following procurement-related tasks in the last 04 years (by the time of registering for the exam):

+ Deliver lectures on procurement;

+ Prepare legal documents on procurement;

+ Engage in the process of selecting preferred bidders and managing the execution of contract packages within the scope of the Law on procurement such as preparing and appraising the plan for selection of preferred bidders; preparing and appraising EOI requests, prequalification documents, procurement documents, requests for proposals; evaluating EOI responses, prequalification applications, bid packages, and proposals; appraising results of the evaluation of EOI responses and prequalification applications, results of the selection of preferred bidders; engaging in negotiation and completion of contracts; engaging in project and contract management (commissioning, payment, revision to contracts, etc.);

- He/she has occasionally engaged in one of the procurement-related tasks specified in Point a of this Clause in the last 05 years (by the time of registering for the exam).

- He/she has engaged in preparing and appraising EOI requests, prequalification documents, procurement documents and EOI responses; evaluating EOI responses, prequalification applications, bid packages and proposals; appraising results of the evaluation of EOI responses and prequalification applications, results of the selection of preferred bidders for at least 05 big contract packages (contract package of supply of non-consulting services and goods procurement with a value of more than VND 10 billion; contract package of construction and mixed contract package with a value of more than VND 20 billion) or 10 small contract packages. Contract packages for the supply of complicated and simple consulting services are equivalent to large and small contract packages respectively.

(5) Pass the exam organized by the Ministry of Planning and Investment.

Is it required to pay fees for issuing procurement practice certificates in Vietnam?

Pursuant to the contents of Clause i, Subsection 1, Section 1, Part A, Appendix II promulgated together with Decision 244/QD-BKHDT in 2019, it is required to pay fees for issuing procurement practice certificates in Vietnam.

However, candidates taking the exam for issuing procurement practice certificates in Vietnam must pay fees for taking the exam as follows:

- In Hanoi and Northern provinces: VND 1,200,000/candidate;

- Da Nang city and central provinces: VND 1,700,000/candidate;

- Ho Chi Minh City and Southern provinces: VND 1,800,000/candidate.
