Pursuant to the provisions of Article 3 of Circular 11/2022/TT-BCT concerning traders eligible to register for participation in the allocation of sugar import tariff quotas via auctions, include:

- Traders who directly use sugar as a production material;

- Traders using raw sugar to produce refined sugar.

What rights and obligations do traders have when registering to participate in the allocation of sugar import tariff quotas via auctions in Vietnam?

The rights and obligations of traders participating in the allocation of sugar import tariff quotas via auctions are stipulated in Article 6 of Circular 11/2022/TT-BCT as follows:

(1) Traders participating in the allocation of sugar import tariff quotas via auctions have the following rights:

- Register for the allocation of sugar import tariff quotas via auctions.

- Participate in the allocation of sugar import tariff quotas via auctions after the Auction Council declares compliance with the provisions in Circular 11/2022/TT-BCT.

(2) Traders participating in the allocation of sugar import tariff quotas via auctions have the following obligations:

- Strictly comply with the provisions in Circular 11/2022/TT-BCT.

- Must pay a deposit before participating in the allocation of sugar import tariff quotas via auctions. The deposit is specified in Clause 2, Article 10 of Circular 11/2022/TT-BCT.

2. Deposit: The deposit value is equivalent to 10% of the value of the sugar quantity the trader registers to participate in the allocation via auctions, calculated according to the starting price.

Where shall traders send their application dossiers to participate in the allocation of sugar import tariff quotas via auctions to in Vietnam?

According to the provisions in Article 11 of Circular 11/2022/TT-BCT regarding the application dossiers for participation in the allocation of sugar import tariff quotas via auctions:

Application dossier for participation in the allocation of sugar import tariff quotas via auctions

1. Each trader sends one application dossier for participation in the allocation of sugar import tariff quotas via auctions, including:

a) Bidding slip (according to the Form in the Appendix attached to this Circular). Each trader can bid with the registered price being either the same or different for 01 (one) unit price and the maximum registered quantity does not exceed 20 (twenty) unit prices. Each unit price has a registered quantity of 1,000 (one thousand) tons.

The bidding slip is placed in a separate envelope, sealed, and signed by the trader at the edges of the envelope and placed inside the application dossier for participation in the allocation of sugar import tariff quotas via auctions. This bidding slip is only opened at the Auction Session.

b) Business registration certificate or Enterprise registration certificate or Investment certificate or equivalent documents: 01 copy, certified and stamped as a true copy of the original by the trader.

c) Document confirming the deposit payment into the account of the Ministry of Industry and Trade: 01 copy, certified and stamped as a true copy of the original by the trader.

2. The application dossier for participation in the allocation of sugar import tariff quotas via auctions must be sealed and clearly marked on the outside of the dossier with the following details:

a) Application dossier for participation in the allocation of sugar import tariff quotas via auctions.

b) Name of the trader.

c) Detailed contact information of the trader (address, phone number, fax number, email address).

3. Place and time for receiving dossiers

a) After the auction session announcement is issued, traders submit the dossier as specified in Clause 1, Clause 2 of this Article by post or directly to the standing committee of the Auction Council (Import-Export Department - Ministry of Industry and Trade, address 23 Ngo Quyen, Hoan Kiem, Hanoi).

b) The time for receiving dossiers is announced in the invitation for participation in the allocation of sugar import tariff quotas via auctions.

c) The time of receipt of the dossier is determined based on the arrival stamp of the Ministry of Industry and Trade.

Each trader sends one application dossier for participation in the allocation of sugar import tariff quotas via auctions by post or directly to the standing committee of the Auction Council (Import-Export Department - Ministry of Industry and Trade, address 23 Ngo Quyen, Hoan Kiem, Hanoi).
