Which subjects are exempt from expressway use fees in Vietnam from October 10, 2024?

Based on Article 6 of Decree 130/2024/ND-CP, the regulation concerning subjects exempt from expressway use fees while traveling on expressways owned, directly managed, and operated by the state includes:

- Ambulances.

- Fire trucks of the fire and rescue police force and fire trucks of other forces mobilized for firefighting duties with priority signals as prescribed by law.

- Specialized vehicles serving national defense purposes, including those with license plates:

+ Red background, embossed white letters and numbers fitted with specialized defense equipment (including: tank trucks, cranes, vehicles transporting armed forces understood as passenger vehicles with 12 seats or more, covered transport vehicles equipped with seats, control vehicles, military inspection vehicles, specialized prisoner transport vehicles, rescue vehicles, satellite communication vehicles, and other special vehicles serving national defense).

+ Vehicles undertaking urgent tasks utilizing one of the priority signals as prescribed by law in cases of emergency duties.

- Specialized vehicles belonging to units within the organization system of the People's Police force, including:

+ Traffic police patrol cars featuring a rotating light atop and the words "CẢNH SÁT GIAO THÔNG" emblazoned on both sides of the vehicle.

+ Police cars labeled "CẢNH SÁT 113" on both sides.

+ Mobile police cars labeled "CẢNH SÁT CƠ ĐỘNG" on both sides.

+ Transport vehicles with installed seats in the bed of the People's Police force vehicles performing duty.

+ Prisoner transport vehicles, rescue vehicles, and other specialized vehicles of the People's Police force.

+ Special vehicles (satellite communication vehicles, bulletproof vehicles, anti-terrorism and riot control vehicles, and other specialized vehicles of the People's Police force).

+ Police force vehicles on emergency missions using priority signals as prescribed by law.

- Specialized vehicles serving funeral services, including:

+ Vehicles with specialized structures for funeral services (including hearses and cold trucks for preserving and transporting bodies).

+ Vehicles related to funeral services (including accompanying passenger vehicles, flower-carrier trucks, portrait-escort vehicles) exclusively used for funeral activities with vehicle registration certificates under the funeral service unit's name.

The funeral service unit must submit a declaration of commitment stating these vehicles are used exclusively for funeral activities to the electronic payment service provider (detailing the number and license plates of each type of vehicle).

- Convoys with escort traffic police vehicles.

- National defense force vehicles participating in exercises, mobilizing forces, transporting weapons, equipment with military specialized escort vehicles.

- Vehicles of the police and defense forces using national road tickets as regulated in Clause 2, Article 8 of Decree 130/2024/ND-CP.

- Dike protection vehicles; vehicles performing emergency missions against floods and storms as directed by competent authorities.

- Vehicles engaged in transporting medicines, machinery, equipment, materials, and goods to areas affected by disasters or to epidemic areas as prescribed by law in the state of emergency when there are major disasters or dangerous epidemics.

What are regulations on issuance of national road tickets in Vietnam?

According to Clause 3, Article 8 of Decree 130/2024/ND-CP, national road tickets are issued as follows:

- Before October 15 each year, the Ministry of National Defense and the Ministry of Public Security prepares a forecast of the quantity and type of national road tickets with specific classifications of vehicles requiring them, and submits to the Directorate for Roads of Vietnam.

- The Directorate for Roads of Vietnam prints and issues national road tickets in December each year. The validity of national road tickets spans from January 1 to December 31 each year.

- After December 15 each year, representatives of the Ministry of National Defense and the Ministry of Public Security bring introduction letters from their respective ministries stating the requester’s name and position, along with the required quantity and type of tickets, and citizen identification to the Directorate for Roads of Vietnam to be issued tickets.

The Directorate for Roads of Vietnam provides the quantity and type of national road tickets as requested. The agency receiving the tickets manages and uses the national roads in compliance with the law.

How to calculate expressway use fee in Vietnam?

Based on Clause 1, Article 9 of Decree 130/2024/ND-CP, which sets out the fees and tolls for expressway usage within the management scope of the Ministry of Transport as follows:

1. expressway use fees are determined based on the actual distance traveled by the vehicle (in km) and the fee corresponding to each vehicle type (in VND/km).

2. The tolls for vehicles traveling on expressways under the Ministry of Transport's management are stipulated in the annex attached to this Decree.

3. Based on the fees specified in Clause 2 of this Article, the tolls applicable to each expressway segment are specifically determined in the Asset Exploitation Scheme approved by the competent authority in accordance with regulations.

Thus, according to these regulations, expressway use fees are determined based on the actual distance traveled by the vehicle (in km) and the corresponding fee for each type of vehicle (in VND/km).
