What time is it prohibited to use honk in Vietnam from January 1, 2025?

Based on the provisions of Article 21 of the Road Traffic Safety Order Law 2024 (Effective from January 1, 2025) regarding the use of vehicle horns as follows:

- Horn signals of vehicles participating in road traffic are only to be used in the following circumstances:

+ Signaling to road traffic participants when a situation may occur that could jeopardize traffic safety;

+ Signaling when preparing to overtake a vehicle.

- Do not use the horn continuously; do not use horns with non-conformable volume; do not use the horn from 10:00 PM the previous day to 5:00 AM the following day in residential areas, medical examination and treatment centers, except for priority vehicles.

Previously, under Clause 12, Article 8 of the Road Traffic Law 2008 (Invalid as of January 1, 2025), one of the prohibited acts was: "Continuous honking, revving engines; honking from 10:00 PM to 5:00 AM, using air horns, using high beams in urban areas and residential areas, except for priority vehicles performing duties as stipulated by this Law."

Therefore, participants in road traffic using cars, motorcycles, and similar vehicles are not allowed to honk continuously anywhere and at any time.

Specifically, it is prohibited to honk the horn between 10:00 PM and 5:00 AM in residential areas and medical examination and treatment centers (except for priority vehicles performing duties as stipulated).

What are administrative penalties for honking between 10:00 PM and 5:00 AM in residential areas, in vicinity of medical examination and treatment establishments in Vietnam from January 1, 2025?

* Operators of cars, four-wheeled vehicles with engines, four-wheeled goods vehicles with engines and vehicles similar to cars

- A fine of 400,000 VND to 600,000 VND if the operator honks the horn from 10:00 PM the previous day to 5:00 AM the following day in residential areas, medical examination and treatment centers (except for priority vehicles performing duties as stipulated).

- A fine of 20,000,000 VND to 22,000,000 VND if the operator commits the above violation and causes a traffic accident.

* Operators of motorcycles, motorbikes, vehicles similar to motorcycles, and vehicles similar to motorbikes

- A fine of 200,000 VND to 400,000 VND if the operator honks the horn from 10:00 PM the previous day to 5:00 AM the following day in residential areas, medical examination and treatment centers (except for priority vehicles performing duties as stipulated).

- A fine of 10,000,000 VND to 14,000,000 VND if the operator commits the above violation and causes a traffic accident.

What is the time limit for imposion of administrative penalties for honking between 10:00 PM and 5:00 AM in residential areas, in vicinity of medical examination and treatment establishments in Vietnam from January 1, 2025?

Based on the provisions of Clause 1, Article 4 of Decree 168/2024/ND-CP regarding the time limit for administrative sanctions as follows:

time limit for handling administrative violations; handling of concluded administrative violations, ongoing administrative violations

1. The time limit for handling administrative violations regarding order and road traffic safety is 01 year.

2. The period for using results obtained through technical and professional equipment and means provided by individuals and organizations to identify violative individuals and organizations is counted from the time the technical and professional equipment and means of the individual or organization record the results until the last day of the time limit for handling administrative violations according to the provisions at Clause 1 of Article 6 of the Law on Handling Administrative Violations.

If time lapses without a decision on penalties being made by the competent authority, the results obtained through technical and professional equipment and means provided by individuals and organizations no longer hold value. Should individuals or organizations intentionally evade or obstruct penalty enforcement, the period for using the results obtained through technical and professional equipment and means is reevaluated from the end of the evasion or obstruction.

3. Concluded administrative violations, ongoing administrative violations

a) The determination of concluded or ongoing administrative violations for the calculation of the time limit for handling administrative violations is conducted per the legal regulations on handling administrative violations;

b) For violations detected through technical and professional equipment and means provided by individuals and organizations: the time the violation ends is calculated from when the equipment records the violation.

Thus, the time limit for imposion of administrative penalties for honking between 10:00 PM and 5:00 AM in residential areas and in vicinity of medical examination and treatment establishments (except for priority vehicles performing duties as stipulated) is 01 year.
