Based on point a, clause 7, Article 7 of Decree 168/2024/ND-CP which states:

Penalty, Points Deduction for Motor Vehicle Drivers, Motorcycles, Vehicles Similar to Motor Vehicles, and Vehicles Similar to Motorcycles Violating Road Traffic Rules

  1. A fine ranging from VND 4,000,000 to VND 6,000,000 shall be imposed on the driver committing one of the following violations:

a) Driving in the opposite direction on one-way streets, driving against the flow on roads with "No Entry" signs, except for violations as noted in point b of this clause and priority vehicles on emergency duties as prescribed; driving on the sidewalk, except when crossing the sidewalk to enter houses, agencies;

  1. In addition to the imposed fines, the driver committing violations will have points deducted from their driver's license as follows:

a) Performing actions specified at point b of clause 3; clause 5; point b, point c, point d of clause 6; point a of clause 7 of this Article will result in a deduction of 02 points from the driver's license;

What is the registration fee for motorcycles in Vietnam?

According to clause 4, Article 8 of Decree 10/2022/ND-CP and clause 1, Article 4 of Circular 13/2022/TT-BTC, the registration fee for motorcycles is stipulated as a rate (%) of 2%. Specific rates for certain cases are as follows:

- Motorcycles owned by organizations or individuals in centrally-controlled cities, provincial cities, district-level towns where the Provincial People's Committee is headquartered: the first registration fee is charged at a rate of 5%.

+ Centrally-controlled cities, provincial cities, district-level towns where the Provincial People's Committee is headquartered are determined according to the state administrative boundaries at the time of filing the registration fee declaration, wherein: centrally-controlled cities include all urban districts, rural districts controlled by the city, regardless of whether they are inner-city districts or suburban districts, urban or rural; provincial cities and district-level towns where the Provincial People's Committee is headquartered include all wards and communes within the city, town, regardless of whether they are inner-city or outer wards, suburban or non-suburban.

- Motorcycles registered for the second time onwards are subject to a fee rate of 1%.

+ In the case where the asset owner has declared and paid a registration fee of 2% for the motorcycle, and then transfers it to an organization or individual in the area specified at point a of this clause, the registration fee will be charged at a rate of 5%. If the motorcycle has been subjected to a 5% registration fee, subsequent transfers will incur a 1% registration fee.

+ The area declared and paid for the previous registration is identified as the "Permanent Residence," "Permanent Residence Registration Location," or "Address" stated in the vehicle registration certificate or the vehicle registration cancellation certificate, plate number, as determined by the state administrative boundaries at the time of registering for the fee.

What is the base price for determining registration fees for motorcycles in Vietnam?

According to clause 3, Article 7 of Decree 10/2022/ND-CP, the base price for the registration fee of motorcycles is based on the Decision on the base price Table issued by the Ministry of Finance.

Currently, the base price table for motorcycle registration fees is stipulated in Decision 2353/QD-BTC 2023, adjusted and supplemented by Decision 449/QD-BTC 2024 and Decision 1707/QD-BTC 2024.

The base price for the motorcycle registration fee is determined as follows:

- The base price at the registration fee table is determined based on principles ensuring conformity with the asset's market transfer price at the time of creating the base price table.

- The market transfer price of each type of car, motorcycle (for cars, motorcycles is by vehicle type; for trucks is by the producing country, brand, allowed loading weight; for buses is by producing country, brand, number of allowable passengers including the driver).

- In case a new type of car, motorcycle arises at the time of filing the registration fee declaration that is not in the base price table, the tax authority will base on the regulatory database to decide the base price of newly arising cars, motorcycles (for cars, motorcycles is by vehicle type; for trucks, is by the producing country, brand, allowed loading weight; for buses, is by producing country, brand, number of allowable passengers including the driver).

- In the case of new cars, motorcycles not listed in the base price table or cars, motorcycles in the base price table where the market transfer price has increased or decreased by 5% or more compared to the price in the base price table, the Tax Department consolidates and reports to the Ministry of Finance before the 5th of the last month of the quarter.

The Ministry of Finance issues a Decision on the adjusted and supplementary base price table before the 25th of the last month of the quarter to be applied from the beginning of the next quarter. The adjusted and supplementary base price table is issued following regulations on the issuance of base price tables as specified or based on the average base price by the local tax authorities.
