What is the Law on Organization of the Government of Vietnam 2025?

On February 18, 2025, the 15th National Assembly of the Socialist Republic of Vietnam, in its 9th extraordinary session, passed the Law on Organization of the Government of Vietnam 2025, No. 63/2025/QH15. This law shall come into effect on March 1, 2025.

According to the Law on Organization of the Government of Vietnam 2025, the Government of Vietnam is the highest state administrative body of the Socialist Republic of Vietnam, exercising executive powers, acting as the executive body of the National Assembly, and is accountable to the National Assembly and reports its work to the National Assembly, the Standing Committee of the National Assembly, and the President.

Additionally, the organizational structure and membership of the Government of Vietnam are prescribed as follows:

- The Government of Vietnam consists of the Prime Minister, Deputy Prime Ministers, Ministers, and Heads of ministerial-level agencies. The structure and number of members of the Government are decided by the National Assembly upon the proposal of the Prime Minister.

- The organizational structure of the Government of Vietnam includes Ministries and ministerial-level agencies.

The establishment and dissolution of Ministries and ministerial-level agencies are decided by the National Assembly upon the Government's proposal.

What are principles for determining the authority of the Government of Vietnam?

Based on Article 6 of the Law on Organization of the Government of Vietnam 2025 (effective from March 1, 2025), the principles for determining the authority of the Government are as follows:

(1) The Government of Vietnam is responsible for submitting to the National Assembly and the Standing Committee of the National Assembly for decisions on content as prescribed by the Constitution and fundamental issues within the National Assembly's authority, issues under the authority of the Standing Committee of the National Assembly as prescribed in the Law on Organization of the National Assembly;

(2) The Government of Vietnam is responsible for cooperating with the People's Courts and the People's Procuracies as prescribed by this Law, the Law on Organization of the People's Courts, the Law on Organization of the People's Procuracies, and other related laws;

(3) The Government of Vietnam guides local governments in performing delegated tasks and powers; local governments independently decide, organize, and take responsibility for delegated tasks and powers;

(4) The Government of Vietnam unifies the state management across sectors and fields; delegates state management to Ministries and ministerial-level agencies, ensuring the clear delineation of responsibility for Ministers and Heads of ministerial-level agencies as members of the Government and as heads of Ministries and agencies;

(5) The Prime Minister is the head of the Government of Vietnam; leads the work of the Government and is responsible to the National Assembly for the Government's activities and assigned tasks, without deciding on matters within the Ministers' and Heads of ministerial-level agencies' authority and responsibility as delegated by the Government. If necessary, the Government and Prime Minister direct and manage the resolution of issues within the tasks and powers of Ministers, Heads of ministerial-level agencies, local governments;

(6) Ministers, Heads of ministerial-level agencies perform tasks and powers according to the principles of authority delegation, decentralization, and delegation as prescribed in this Law and the Law on Organization of Local Governments and other related laws;

(7) The delegation and decentralization must ensure clear entities, content, task, power scope, publicity, transparency, accountability, supervision, inspection, auditing, and control of power as prescribed by the Constitution and law;

(8) The provisions of functions, tasks, powers, and responsibilities of the Government, Prime Minister, and Ministries in other legal normative documents must conform with this Law, ensuring effective state power control;

(9) Encourage central and local government agencies to proactively propose delegation and decentralization with related mechanisms, policies, solutions to effectively implement delegation and decentralization to enhance flexibility, creativity, resource liberation, and promote socio-economic development.

Is the Ministry of Finance of Vietnam part of the Government of Vietnam?

According to Article 1 of Resolution 176/2025/QH15, the organizational structure of the Government of the 15th National Assembly tenure comprises 14 Ministries and 03 ministerial-level agencies:

1. Ministry of Defense;

2. Ministry of Public Security;

3. Ministry of Foreign Affairs;

4. Ministry of Interior;

5. Ministry of Justice;

6. Ministry of Finance;

7. Ministry of Industry and Trade;

...

Thus, the Ministry of Finance is currently still part of the Government of Vietnam.

What are the rights and responsibilities of the Ministry of Finance in managing fees and charges?

According to Article 18 of Law on Fees and Charges 2015, the authority and responsibility of the Government of Vietnam on fees and charges are as follows:

- Unified state management of fees and charges.

- Between two National Assembly sessions, submit to the Standing Committee of the National Assembly for consideration, decision on amendments, supplements, and abolition of fees and charges.

- Prescribe the collection, exemption, reduction, remittance, management, and use of fees and charges within authority.

- Present to the Standing Committee of the National Assembly regulations on collecting, exempting, reducing, collecting, managing, and using court fees and charges.

- Guide the unified implementation of fees and charges in the List of fees and charges promulgated with the Law on Fees and Charges 2015.
