[1] For new issuance or renewal of the certificate of registration for multi-level marketing: 5,000,000 VND/01 appraisal.

According to sub-section 1, Section 2 of Decision 1299/QD-BTC 2023, specific regulations on the components of the application for issuance of a certificate of registration for multi-level marketing are as follows:
The application for a certificate of registration for multi-level marketing includes:
- 01 Application form for a certificate of registration for multi-level marketing according to Form No. 01 in the Appendix issued together with Decree 40/2018/ND-CP as amended by Decree 03/2023/ND-CP.
- 01 certified copy of the business registration certificate or equivalent legal document.
- 01 list accompanied by certified copies of valid personal identification documents (identity card or citizenship card or passport for Vietnamese individuals; passports and legal residence documents issued by competent Vietnamese authorities for foreigners residing in Vietnam; passports for foreigners not residing in Vietnam) for individuals mentioned in point c clause 1 Article 7 of Decree 40/2018/ND-CP as amended by clause 3 Article 1 of Decree 18/2023/ND-CP.
- 01 certified copy of the legal documents on the establishment of the organization in case of an organization.
- 02 (two) sets of documents related to the multi-level marketing of the enterprise, including: Multi-level marketing participation contract template; Reward payment plan; Basic training program; Operational rules.
- 01 list of goods traded in by multi-level marketing methods of the enterprise, including information: Name, type, origin, packaging specifications, warranty policies (if any), selling price, and the reward points equivalent to the selling price, applicable time.
- 01 original of the escrow confirmation document;
- Technical explanation document about the information technology system managing the multi-level marketing network that meets the regulations in Article 44 of Decree 40/2018/ND-CP as amended by clause 33 Article 1 Decree 18/2023/ND-CP, which must include the following basic information:
+ Server IP address and physical server location;
+ The operation mechanism of the system, including a description of the system, data entry and storage methods, and data management methods;
+ Information specified in Article 44 Decree 40/2018/ND-CP as amended by clause 33 Article 1 Decree 18/2023/ND-CP.
- Documents proving the enterprise has a website that meets the regulations in Article 45 of Decree 40/2018/ND-CP;
- Documents proving the enterprise has a communication system to receive and resolve inquiries and complaints from multi-level marketing participants.
- Audited financial statements or documents confirming tax or financial obligations in the three most recent financial years or equivalent documents issued or confirmed by competent authorities or organizations to demonstrate compliance with the conditions specified in point h clause 1 Article 7 of Decree 40/2018/ND-CP as amended by clause 3 Article 1 Decree 18/2023/ND-CP, in the case where the organization registering for multi-level marketing is a foreign-invested enterprise or a foreign-invested economic organization as an owner, member, or shareholder.
- Business license covering retail distribution rights, including multi-level marketing operations, in case enterprises have foreign investors, or economic organizations with foreign investment are owners or members or shareholders.
What is the procedure for issuing a certificate of registration for multi-level marketing in Vietnam?
According to sub-section 1, Section 2 of Decision 1299/QD-BTC 2023, specific regulations on the components of the application for issuance of a certificate of registration for multi-level marketing are as follows:
- Enterprises registering multi-level marketing submit 01 set of applications stipulated in Article 9 Decree 40/2018/ND-CP as amended and supplemented by clause 33 Article 1 Decree 18/2023/ND-CP together with electronic documents in ".doc" or ".docx" format for the documents specified in clause 4 Article 9 and in ".xls" or ".xlsx" format for the documents as specified in clause 5 Article 9 to the Office of the National Competition Commission - Ministry of Industry and Trade (5th floor, 25 Ngo Quyen - Hoan Kiem, Hanoi);
- Receipt and checking completeness and validity of the application: Within 05 working days from the date of receiving the application, the National Competition Commission checks the completeness and validity of the application. In case the application is not complete or valid, the National Competition Commission notifies the enterprise to amend and supplement the application within 30 days. If the application is complete and valid, the National Competition Commission proceeds to appraisal.
In cases where the multi-level marketing enterprise does not amend or supplement the application as requested within 30 days from the date the National Competition Commission issues a notice on amending and supplementing the application, the National Competition Commission returns the application to the enterprise.
- Appraisal of the application: After receiving a complete and valid application, the National Competition Commission notifies the enterprise to pay the appraisal fee. The National Competition Commission returns the application if the enterprise does not pay the appraisal fee within 30 days from the date of issuing the notification; the National Competition Commission appraises the application within 20 working days from the date of receiving the appraisal fee.
