How many days off are tax officials entitled to in the 2025 Gregorian New Year in Vietnam?

Pursuant to Article 112 of the Labor Code 2019 which provides regulations on holidays, New Year days when employees can take leave with full pay:

Holidays and New Year

1. Employees shall be entitled to full-paid days off on the following holidays and New Year days:

a) Gregorian New Year: 01 day (on January 1 according to the Gregorian calendar);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (on April 30 according to the Gregorian calendar);

d) International Labor Day: 01 day (on May 1 according to the Gregorian calendar);

dd) National Day: 02 days (on September 2 according to the Gregorian calendar and 01 adjacent day before or after);

e) Hung Kings Commemoration Day: 01 day (10th of the 3rd lunar month).

2. Foreign employees working in Vietnam, in addition to the days off prescribed in Clause 1 of this Article, shall also be entitled to an additional day off on their national traditional New Year and their National Day.

3. Annually, based on actual conditions, the Prime Minister of the Government of Vietnam shall specifically decide the days off specified at Point b and Point đ, Clause 1 of this Article.

Thus, the Gregorian New Year 2025 falls on a Wednesday, so tax officials will have 01 day off on January 1, 2025, and will receive full pay.

However, employees can take additional leave in the following ways:

(1) Paid leave

According to Article 114 of the Labor Code 2019, employees will have 12 to 16 days of paid leave if they complete a full year of work. Therefore, if employees have remaining leave days or can take advance leave, they can use their leave to have a longer than mandated New Year holiday.

(2) Combining leave

According to Clause 4, Article 113 of the Labor Code 2019, tax officials can agree with their employer to take multiple periods of leave or combine leave up to 3 years at a time.

In cases where superiors agree to combined leave, tax officials are entitled to full pay for additional leave days.

(3) Unpaid leave

Tax officials can negotiate with their agency or superior to take unpaid leave if they have exhausted their annual leave entitlement or wish to conserve leave days.

Note: Taking additional leave by combining leave or taking unpaid leave must be agreed upon and approved by a superior or the working agency; if employees unilaterally take leave, they may be regarded as having abandoned their post.

How many total days off are tax officials entitled to in the 2025 Tet holiday in Vietnam?

Recently, the Government Office of Vietnam issued Official Dispatch 8726/VPCP-KGVX of 2024 conveying directives from the Prime Minister of the Government of Vietnam concerning the Lunar New Year and several holidays in 2025.

The Prime Minister agreed with the proposal of the Ministry of Labor, Invalids and Social Affairs regarding the Lunar New Year leave for officials and public employees as follows:

- For the Lunar New Year in 2025, officials and public employees will get 9 consecutive days off, including 5 days for the New Year holiday and 4 weekend days.

- To be specific:, officials and public employees will have 5 days off for the Lunar New Year from Monday, January 27, 2025, until the end of Friday, January 31, 2025 (from the 28th of the twelfth lunar month of the Year of the Dragon until the 3rd of the lunar January of the Year of the Snake).

- However, as in 2025, all 5 days of the Lunar New Year holiday fall on weekdays, employees will also have 2 additional weekend days before and 2 weekend days after the New Year holiday.

Departments and units should arrange for on-duty shifts according to regulations and work arrangement to ensure continuous task handling and good service for organizations and the public, paying particular attention to assigning on-duty officials to handle unforeseen or urgent tasks that may arise during the Tet holiday and other holidays as per regulations.

Ministries, agencies, and localities should have plans and appropriate measures to encourage units, businesses, organizations, and individuals to actively, proactively deploy production, business, economic, and social activities, ensuring stability in the supply and demand of goods, services, prices, and markets, contributing to promoting production, business, economic growth, practicing thrift, combating waste, and striving to successfully implement the objectives, tasks set out in the plan for 2025, a year of acceleration and breakthrough in implementing the 5-year plan 2021 - 2025, creating a solid foundation and premise for rapid and sustainable development in the coming time.

Thus, tax officials are entitled to a total of 9 days off for the 2025 Tet holiday. This will be from January 25 to February 2, 2025 (from the 26th of the twelfth lunar month to the end of the 5th of the lunar January).
