Based on the Appendix on Fees and Charges in veterinary issued with Circular 101/2020/TT-BTC, the table for Slaughtering control fees in veterinary is as follows:

Are livestock farms subject to environmental protection fees in Vietnam?

Based on the provisions at point b, clause 2, Article 2 of Decree 53/2020/ND-CP as follows:

Subjects of Fees

1. The subjects of environmental protection fees under this Decree are industrial wastewaterd into receiving water bodies as prescribed by law and domestic wastewater, except for cases exempt from fees as prescribed in Article 5 of this Decree.

2. Industrial wastewater is wastewater from factories, places, and production facilities (hereinafter referred to as facilities) of organizations, households, individuals, including:

a) Processing and production facilities: agricultural products, forest products, aquatic products, food, alcohol, beer, beverages, tobacco.

b) Livestock farms and poultry farms at farm scale as prescribed by law on livestock; livestock and poultry slaughter facilities.

c) Aquaculture facilities required to prepare an environmental impact assessment report or environmental protection plan as prescribed.

d) Handicraft production facilities in craft villages.

dd) Facilities: leather processing, leather recycling, textile, dyeing, garment production.

e) Facilities: mineral extraction and processing.

g) Manufacturing facilities: paper, pulp, plastic, rubber; components, electrical equipment, electronics;

h) Facilities: mechanical, metallurgy, metal processing, machinery and parts manufacturing.

i) Facilities: scrap preliminary processing, shipbreaking, ship cleaning, waste treatment.

k) Facilities: basic chemicals, fertilizers, pharmaceuticals, plant protection chemicals, building materials, stationery, household goods.

l) Clean water supply plants, power plants.

m) Centralized wastewater treatment systems in urban areas.

n) Centralized wastewater treatment systems in industrial zones, industrial clusters, export processing zones, economic zones, fish ports, high-tech areas, and other zones.

o) Other production and processing facilities that discharge wastewater from operational activities.

3. Domestic wastewater is wastewater from activities of:

a) Households and individuals.

b) Government agencies, public service providers, people's armed units, and other organizations (including headquarters, branches, and offices of these agencies, units, or organizations), except for production facilities and processing facilities of these agencies, units, or organizations.

c) Motor vehicle washing, motorbike washing, car repair, and motorbike repair facilities.

d) Medical examination and treatment facilities; restaurants, hotels; training, research institutions.

dd) Other business and service facilities not within the scope of clause 2 of this Article.

Hence, livestock farms at a farm scale will incur environmental protection fees when there is industrial wastewater.

What entities are environmental protection fee collectors on wastewater in Vietnam?

According to Article 4 of Decree 53/2020/ND-CP, the provisions are as follows:

Fee Collection Organization

The organizations collecting environmental protection fees on wastewater include:

  1. The Department of Natural Resources and Environment, District Department of Natural Resources and Environment collect environmental protection fees on industrial wastewater from facilities under management in the local area. Based on actual management conditions, the Department of Natural Resources and Environment reports to the People's Committee of the province or city under central authority to direct the Department and District Department of Natural Resources and Environment to organize the collection of environmental protection fees on wastewater from facilities in the area.
  1. The organization providing clean water collects environmental protection fees on domestic wastewater from organizations, households, and individuals using the clean water source they provide.
  1. The People's Committee at the ward or commune level collects environmental protection fees on domestic wastewater from businesses, business households, and individuals in the area who self-extract water for use.

Based on Article 3 of Decree 53/2020/ND-CP, the authority to collect environmental protection fees on wastewater pertains to:

- The Department of Natural Resources and Environment, District Department of Natural Resources and Environment collect environmental protection fees on industrial wastewater from local facilities under management. Based on actual management conditions, the Department reports to the People's Committee of provinces and cities under central authority to direct the Department and District Department of Natural Resources and Environment to organize the collection of these fees on wastewater from local facilities.

- The organization providing clean water collects environmental protection fees on domestic wastewater from organizations, households, and individuals using the clean water they provide.

- The People's Committee at the ward or commune level collects environmental protection fees on domestic wastewater from business organizations, business households, and individuals in the area who self-extract water for use.
