How to calculate the advance court cost for civil cases in Vietnam?
Pursuant to Article 7 of Resolution 326/2016/UBTVQH14, specific provisions regarding the advance court cost and advance court charges are as follows:
[1] The advance appellate civil court cost in criminal cases is equal to the advance appellate civil court cost.
[2] The advance first instance civil court cost in non-monetary civil cases equals the first instance civil court cost for cases that involve no monetary value. The advance first instance civil court cost in monetary civil cases is 50% of the estimated first instance civil court cost for cases that involve a monetary value as anticipated by the court based on the disputed asset value requested by the plaintiff, but not less than the first instance civil court cost for non-monetary civil cases.
Note:
The advance appellate civil civil court cost equals the appellate civil court cost.
[3] The advance first instance administrative court cost equals the first instance administrative court cost. The advance appellate administrative court cost equals the appellate administrative court cost. The advance appellate civil court cost in administrative cases equals the advance appellate civil court cost.
[4] For civil, marriage and family, business, commerce, labor administrative cases resolved under simplified procedures, the advance court cost is 50% of the advance court cost stipulated in clause 2 Article 7 of Resolution 326/2016/UBTVQH14 and clause 3 Article 7 of Resolution 326/2016/UBTVQH14.
