Based on Article 7 of Decree 168/2024/ND-CP, which stipulates penalties and license point deductions for operators of motorcycles, mopeds, and similar vehicles that violate traffic regulations:

  1. A fine from 2,000,000 VND to 3,000,000 VND shall be imposed on operators committing one of the following violations:

a) Operating a vehicle on the road with a blood alcohol concentration not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath;

...

  1. A fine from 6,000,000 VND to 8,000,000 VND shall be imposed on operators committing one of the following violations:

...

b) Operating a vehicle on the road with a blood alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath.

...

  1. A fine from 8,000,000 VND to 10,000,000 VND shall be imposed on operators committing one of the following violations:

...

d) Operating a vehicle on the road with a blood alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath;

...

  1. In addition to the primary penalties, operators who commit violations may also face the following additional penalties:

a) Performing acts described at point đ of clause 2 of this Article may result in the confiscation of unlawfully installed priority signaling devices;

b) Performing acts described at points a, b, h, i, k of clause 9 of this Article may result in a suspension of operating privileges from 10 to 12 months;

c) Performing acts described at points d, đ, e, g of clause 9; clause 11 of this Article may result in a suspension of operating privileges from 22 to 24 months.

  1. In addition to the penalties, operators who commit violations may also have points deducted from their driver license as follows:

a) Performing acts described at point b of clause 3; clause 5; points b, c, d of clause 6; point a of clause 7 of this Article may result in a deduction of 02 points from the driver license;

b) Performing acts described at point dd of clause 4; point a of clause 6; points c, d, đ of clause 7; point a of clause 8 of this Article may result in a deduction of 04 points from the driver license;

c) Performing acts described at point b of clause 7, point c of clause 9 of this Article may result in a deduction of 06 points from the driver license;

d) Performing acts described at point b of clause 8, clause 10 of this Article may result in a deduction of 10 points from the driver license.

According to the above regulations, when operators of motorcycles, mopeds, and similar vehicles (collectively referred to as mopeds) drink alcohol while operating, they are fined depending on the blood or breath alcohol concentration as follows:

- A fine from 2,000,000 VND to 3,000,000 VND is imposed on operators operating with a blood alcohol concentration not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath, with a deduction of 04 points from the driver license.

- A fine from 6,000,000 VND to 8,000,000 VND is imposed on operators operating with a blood alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath, with a deduction of 10 points from the driver license

- A fine from 8,000,000 VND to 10,000,000 VND is imposed on operators operating with a blood alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath. Additionally, the drivers may face additional fines of having their operating license suspended from 22 to 24 months.

Based on clause 10, Article 2 of Decree 163/2016/ND-CP, the regulations are as follows:

State Budget Revenue

  1. Revenue from government-owned assets; revenue from mineral resource extraction fees, and water resource extraction fees.
  1. Revenue from administrative fines, penalties, and other confiscations as prescribed by law.
  1. Voluntary contributions from organizations and individuals both domestic and international.

...

Thus, revenue from administrative fines belongs to the state's budget revenue.

Do Vietnam's state budget revenues include taxes?

According to clause 1, Article 2 of Decree 163/2016/ND-CP regarding state budget revenue:

  1. Taxes paid by organizations and individuals in accordance with tax law.
  1. Fees paid by organizations and individuals in accordance with the law.
  1. Charges collected from service activities conducted by state agencies; after being budgeted for operational expenses, they are deductible.
