What are the penalties for traffic violations on motorcycles in Vietnam in 2025?

Pursuant to Article 7 of Decree 168/2024/ND-CP which stipulates specific penalties for traffic violations committed by motorcycle users in 2025 as follows:

(1) A fine ranging from VND 200,000 to VND 400,000 shall be imposed on motorcycle operators for committing one of the following violations:

(i) Failing to signal before overtaking or having the signal but not using it throughout the overtaking process;

(ii) Reversing a tricycle motorcycle without observing both sides, behind the vehicle, or without a reverse signal;

(iii) Carrying a passenger who uses an umbrella;

(iv) Not complying with the regulations on giving way at intersections, except for violations stated in (iii), (iv) at (6);

(v) Changing lanes in unauthorized places or without signaling in advance or lane changing non-conformably, allowing only one adjacent lane change each time;

(vi) Not using headlights during the period from 6:00 PM of the previous day to 6:00 AM the next day or in foggy, smoky, dusty, rainy, or adverse weather conditions reducing visibility;

(vii) Failing to yield appropriately; using high beams when encountering pedestrians crossing or on segments of roads with active lighting systems, or when encountering oncoming vehicles (except barrier systems capable of glare prevention) or when turning at intersections; not yielding to oncoming vehicles according to regulations on narrow roads, slopes, or obstructions;

(viii) Using horns from 10:00 PM the previous day to 5:00 AM the next day in densely populated, medical zones, except for emergency vehicles on duty as prescribed;

(ix) Operating a vehicle below the minimum speed on roads with prescribed minimum speed limits.

(x) Not complying with the orders, directions of traffic signs, road markings, except for violations (ii), (iv), (v) at (2); (i), (iii), (iv), (viii) at (3); (i), (ii), (iii), (iv) at (4); (ii), (iii) at (6); (i), (ii), (iii) at (7); (i) at (8); (ii) at (9); (i) at (10);

(2) A fine ranging from VND 400,000 to VND 600,000 shall be imposed on motorcycle operators for committing one of the following violations:

(i) Stopping or parking on the road in non-urban areas where there are roadside areas;

(ii) Operating a vehicle exceeding the speed limit from 05 km/h to less than 10 km/h;

(iii) Operating a vehicle at low speed on the wrong side of the road causing traffic obstruction;

(iv) Stopping or parking in a roadway causing traffic obstruction; gathering of 03 or more vehicles on the roadway, in tunnels; parking illegally on sidewalks or roadways;

(v) Unauthorized vehicles installing, using priority signal devices of priority vehicles;

(vi) Stopping or parking at bus stops, at intersections, on pedestrian crossings; stopping where there are signs "No stopping and parking"; parking where there are signs "No parking" or "No stopping and parking"; not complying with stopping or parking regulations at level crossings with railways; stopping or parking within railway safety corridors;

(vii) Carrying 02 passengers on a motorcycle, except in cases of transporting patients for emergency treatment, children under 12 years old, elderly or disabled persons, escorting law violators;

(viii) Not wearing a "helmet for motorcycles or scooters" or wearing a helmet without properly fastening the straps when operating on roads;

(ix) Carrying passengers without wearing "helmets for motorcycles or scooters" or improperly fastening the same, except for transporting patients for emergency treatment, children under 06 years old, or escorting law violators;

(x) Making U-turns in prohibited areas, except as violated in regulation (iv) at (4).

(3) A fine ranging from VND 600,000 to VND 800,000 shall be imposed on motorcycle operators for committing one of the following violations:

(i) Changing direction without observing or ensuring a safe distance with the vehicle behind or reducing speed or signaling, or signaling but not continuously during direction change (unless driving along a curved road with no level intersections); turning left where there are signs prohibiting left turns for the type of vehicle being operated; turning right where there are signs prohibiting right turns for the type of vehicle being operated;

(ii) Carrying from 03 or more passengers on a motorcycle;

(iii) Stopping or parking on bridges;

(iv) Not driving on the right according to the prescribed direction; not using the correct lane specified (in flow direction or opposite lane); driving across fixed central dividers dividing two traffic lanes;

(v) Overtaking on the right in unauthorized circumstances;

(vi) Operating or carrying passengers holding onto, pulling, pushing other vehicles or objects, leading animals, carrying bulky objects; carrying passengers standing on seats, luggage racks, or sitting on the handlebars;

(vii) Towing another vehicle or object with the motorcycle;

(viii) Driving in tunnels without using low beams;

(ix) Not keeping a safe distance resulting in a collision with the vehicle directly in front or not keeping the distance as indicated by the "Minimum distance between vehicles" sign;

(x) Operating a motorcycle in a horizontal line with 03 or more motorcycles;

(xi) Priority vehicles using unauthorized priority signal equipment or without a permit from competent authorities or using obsolete or invalid permits.

(4) A fine ranging from VND 800,000 to VND 1,000,000 shall be imposed on motorcycle operators for committing one of the following violations:

(i) Operating a vehicle exceeding the prescribed speed limit from 10 km/h to 20 km/h;

(ii) Stopping or parking in tunnels at unauthorized locations;

(iii) Overtaking in unauthorized conditions, overtaking where there are signs prohibiting overtaking for the type of vehicle being operated, except as violated in regulation (v) at (3);

(iv) Making U-turns in tunnels;

(v) Using umbrellas, audio devices (except hearing aids), holding and using phones or other electronic devices while operating a motorcycle.

(5) A fine ranging from VND 1,000,000 to VND 2,000,000 shall be imposed on motorcycle operators for committing one of the following violations:

(i) Operating a vehicle involved in a traffic accident without immediately stopping the vehicle, preserving the scene, or assisting victims, except as violated in regulation (iii) at (9);

(ii) Changing direction without yielding priority to pedestrians, or wheelchairs of disabled persons crossing roads at zebra crossings; rudimentary vehicles using assigned rudimentary vehicle lanes;

(iii) Changing direction without yielding to: oncoming traffic; pedestrians, rudimentary vehicles crossing roads at non-pedestrian crossings.

(6) A fine ranging from VND 2,000,000 to VND 3,000,000 shall be imposed on motorcycle operators for committing one of the following violations:

(i) Operating a vehicle on the road while having a blood or breath alcohol concentration not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath;

(ii) Entering prohibited areas or roads with signs indicating restricted entry for the type of vehicle being operated, except violations as stipulated in (i), (ii) at (7) and emergency vehicles performing urgent tasks according to regulations;

(iii) Not reducing speed (or stopping) and yielding when entering from non-priority roads to priority roads, from branch roads to main roads;

(iv) Not reducing speed and yielding to vehicles coming from the right at intersections without roundabout signs; not reducing speed and yielding to vehicles coming from the left at intersections with roundabout signs.

(7) A fine ranging from VND 4,000,000 to VND 6,000,000 shall be imposed on motorcycle operators for committing one of the following violations:

(i) Driving against the one-way street direction or opposite direction on streets with "No entry" signs, except as violated in regulation (ii) and emergency vehicles on duty as per regulations; driving on sidewalks, except when driving over sidewalks to enter homes or buildings;

(ii) Operating a motorcycle on the highway, except for vehicles managing or maintaining the highway;

(iii) Disobeying traffic lights;

(iv) Disobeying the orders or guidance of traffic controllers or supervisors;

(v) Not yielding or obstructing priority vehicles emitting priority signals on duty.

(8) A fine ranging from VND 6,000,000 to VND 8,000,000 shall be imposed on motorcycle operators for committing one of the following violations:

(i) Operating a vehicle exceeding the prescribed speed limit by over 20 km/h;

(ii) Operating a vehicle with a blood alcohol concentration superior to 50 milligrams up to 80 milligrams/100 milliliters of blood or surpassing 0.25 milligrams up to 0.4 milligrams/1 liter of breath.

(9) A fine ranging from VND 8,000,000 to VND 10,000,000 shall be imposed on motorcycle operators for committing one of the following violations:

(i) Driving dangerously or weaving on roads; using kickstands or other objects to scrape the road while the vehicle is moving;

(ii) Operating motorcycles in groups of 02 or more exceeding the speed limit;

(iii) Involved in a traffic accident without immediately stopping the vehicle, preserving the scene, assisting victims, remaining, or reporting the accident to the nearest police station or People's Committee;

(iv) Operating a vehicle with a blood alcohol concentration over 80 milligrams/100 milliliters of blood or surpassing 0.4 milligrams/1 liter of breath;

(v) Disobeying requests by officials for alcohol concentration tests;

(vi) Operating a motorcycle with prohibited narcotic substances or stimulants in the body;

(vii) Disobeying requests by officials for testing prohibited narcotic substances or stimulants;

(viii) Sitting behind while reaching around the driver, except when carrying children under 06 years old;

(ix) Motorcycle formations obstructing traffic, unless permitted by competent authorities;

(x) Using horns, revving engines continuously in densely populated areas or medical zones, except for emergency vehicles on duty according to regulations.

(10) A fine ranging from VND 10,000,000 to VND 14,000,000 shall be imposed on motorcycle operators for committing one of the following violations:

(i) Operating a vehicle without observing, reducing speed, or stopping to ensure safety as required, causing a traffic accident; speeding causing a traffic accident; entering highways, stopping, parking, making U-turns, reversing, overtaking, changing direction, lane changing improperly, causing a traffic accident; not keeping the correct lane or safe distance according to regulations, causing a traffic accident, or entering roads with signs indicating restricted entry for the type of vehicle being operated, driving against the one-way direction, driving against streets with "No entry" signs causing a traffic accident;

(ii) Violating the rules at one of the points, clauses in this Article causing a traffic accident: (i), (iv), (v), (vii), (viii), (ix), (x) at (1); (iii), (v), (vii) at (2); (ii), (vi), (vii), (viii), (ix) at (3); (v) at (4); (iii), (iv) at (6); (iii), (iv), (v) at (7); (i), (ii), (viii), (x) at (9).

(11) Vehicle confiscation against motorcycle operators who commit one of the following violations:

- Releasing both hands while driving; using feet to operate the vehicle; sitting sideways to operate the vehicle; lying on the seat to control the vehicle; switching operators while the vehicle is moving; turning around to operate or driving blindfolded;

- Operating a two-wheel motorcycle on one wheel, a three-wheel motorcycle on two wheels;

- Repeat offenses of dangerous driving or weaving as stipulated in point a, clause 9, Article 7 of Decree 168/2024/ND-CP.

(12) In addition to the principal penalties, motorcycle operators committing violations may also be subject to the following supplementary penalties:

(i) Violating the provisions at point e, clause 2 of this Article may also result in confiscation of unauthorized priority signal equipment;

(ii) Violating provisions at (i), (ii), (viii), (ix), (x) at (9) leading to revocation of the driver's license from 10 to 12 months;

(iii) Violating provisions at (iv), (v), (vi), (vii) at (9); (11) leading to revocation of the driver's license from 22 to 24 months.(13) In addition to being subject to a penalty, drivers who commit violations will also have points deducted from their driver's license as follows:

(i) Committing the acts specified in (ii) at (3); (5); (ii), (ii), (iii) at (6); (i) at (7) will result in a deduction of 2 points from the driver's license;

(ii) Committing the acts specified in (v) at (4); (i) at (6); (iii), (iv), (v) at (7); (i) at (8) will result in a deduction of 4 points from the driver's license;

(iii) Committing the acts specified in (ii) at (7), (iii) at (9) will result in a deduction of 6 points from the driver's license;

(iv) Committing the acts specified in (ii) at (8), (10) will result in a deduction of 10 points from the driver's license.

Is there a registration fee on motorcycles in Vietnam?

According to Article 3 of Decree 10/2022/ND-CP which regulates the subjects subject to registration fees specifically as follows:

Subjects subject to registration fees

1. Houses, land.

2. Hunting guns; guns used for training, sports competition.

3. Ships according to the law on inland waterway traffic and maritime law (hereinafter referred to as watercraft), including barges, canoes, tugboats, push boats, submarines, submersibles; except floating docks, floating storage, and movable rigs.

4. Boats, including yachts.

5. Aircraft.

6. Two-wheeled motorbikes, three-wheeled motorbikes, motorcycles, other vehicles similar to motorbikes, motorcycles that must be registered and have license plates issued by competent state authorities (hereinafter collectively referred to as motorcycles).

7. Cars, trailers, or semi-trailers pulled by cars, other vehicles similar to cars that must be registered and have license plates issued by competent state authorities.

8. Hulls, complete chassis, complete engines, engine blocks of the assets specified in clauses 3, 4, 5, 6, and 7 of this Article are replaced and must be registered with competent state authorities.

The Ministry of Finance shall detail this Article.

Thus, motorcycles are among the subjects required to pay registration fees.

What is the rate of registration fee for motorcycles in Vietnam?

Based on Clause 4, Article 8 of Decree 10/2022/ND-CP and Clause 1, Article 4 of Circular 13/2022/TT-BTC which regulate the rate of registration fee for motorcycles by percentage (%) as 2%. The fee for specific cases is as follows:

- Motorcycles of organizations, individuals in centrally-affiliated cities; provincial cities; district-level towns where the provincial people's committee is located: first-time registration fee rate is 5%.

Centrally affiliated cities, provincial cities; district-level towns where the provincial people's committee, centrally affiliated city is located, are determined according to the administrative geographical boundaries of the state at the time of declaring registration fees, in which: Centrally affiliated cities include all districts and rural districts affiliated with the city, regardless of urban or rural, inner or outer districts; Provincial cities and district-level towns where the provincial people's committee is located include all wards and communes in the city, district-level towns, regardless of being urban, suburban, or town areas.

- Motorcycles paying registration fees from the second time onwards will apply a fee rate of 1%.

If the asset owner initially declared and paid a registration fee of 2% for the motorcycle, and then transfers it to an organization or individual in the area specified in point a of this clause, the registration fee rate will be 5%. If the motorcycle had previously paid a 5% registration fee, subsequent transfers shall pay a 1% registration fee.

The area where the previous registration fee was declared and paid is determined according to "Permanent residence", "Registered place of permanent residence", or "Address" recorded in the vehicle registration certificate or registration certificate cancellation, vehicle license plate and is determined according to the state's administrative geographical boundaries at the time of declaring registration fees.
