What are procedures for registration for legal knowledge test for restoration of driver license points in Vietnam from January 1, 2025?

Based on Section 2 of the new administrative procedures in the field of legal knowledge testing on road traffic order and safety under the jurisdiction issued together with Decision 9303/QD-BCA in 2024 (effective from January 1, 2025) by the Ministry of Public Security, the procedure for registering to legal knowledge test for restoration of driver license points is guided as follows:

- Step 1: The registrant for testing legal knowledge on road traffic order and safety to recover license points prepares a dossier as prescribed by law.

The dossier includes:

+ An application for testing legal knowledge on road traffic order and safety (Form No. 01 Appendix issued under Circular 65/2024/TT-BCA).

+ A health check certificate for the driver issued by a competent medical authority still valid for use.

- Step 2: The registrant submits the dossier on the National Public Service Portal, the Ministry of Public Security’s Public Service Portal, the National Identification Application; directly or via postal service to the Traffic Police Department, the Ministry of Public Security, or the Traffic Police Division of the provincial or municipal police directly under the Central Government.

*Note: In case of online submission, the registrant registers the test date and chooses the competent authority for testing (Traffic Police Department, the Ministry of Public Security, or Traffic Police Division of the provincial or municipal police directly under the Central Government).

- Step 3: Upon receiving the dossier, the competent authority checks the legality and content of the dossier.

The public service portal or National Identification Application confirms the successful submission, generates a public service code, and sends the dossier to the management system for testing legal knowledge on road traffic order and safety. The official in charge of receiving the dossier examines the information, verifies the legality of the dossier, and sends confirmation to the public service portal.

In the case of direct submission, the official receiving the dossier checks it.

- Step 4: The public service portal or National Identification Application notifies via phone message, email address, or notification on the National Identification Application (hereinafter referred to as notification) to inform the registrant about the time and place of the test.

In the case of direct submission, the official writes an appointment note specifying the time and place of the test.

*Note: Those with unsatisfactory test results may register to retest at the authority that conducted the previous test or choose a competent authority to request a retest. In case of a retest request, if the health check certificate is still valid, the registrant only submits the request for a test.

What is the fee for issuing a driver license in Vietnam?

Based on the Fee Schedule for driver license Examination; Fees for Issuing Certificates for Operation on Various Vehicles and Fees for Registration and Issuance of Registration Plates for Special Use Motorcycles issued under Circular 37/2023/TT-BTC, the fees for automobile driver license examination are as follows:

- New issuance of driver license (national and international): 135,000 VND/time.

- Reissuance of driver license (national and international): 135,000 VND/time.

- Renewal of driver license (national and international): 135,000 VND/time.

What are regulations on management and use of the fees for issuing driver licenses in Vietnam?

Based on Article 5 of Circular 37/2023/TT-BTC regulating the management and usage of fees for issuing driver licenses as follows:

- The fee-collecting organization must pay 100% of the collected fees into the state budget. The funding for service provision and fee collection activities is arranged by the state budget in the allocation of the fee-collecting organization according to policies and budget expenditure norms as prescribed by law.

- In cases where the fee-collecting organization is contracted for operating expenses from fee revenue as stipulated in Clause 1, Article 4 of Decree 120/2016/ND-CP, 75% of the collected fee amount may be retained to cover the costs of service provision and fee collection as stipulated in Article 5 of Decree 120/2016/ND-CP; 25% of the collected fee amount is paid into the state budget.

In circumstances where localities face difficulties in material conditions and have not yet established examination centers meeting material conditions, but are permitted by the Ministry of Transport to conduct driver testing at old centers or sites, the fee-collecting organization is allowed to retain 40% of the collected fee amount to cover the costs of service provision and fee collection as stipulated in Article 5 of Decree 120/2016/ND-CP; 60% of the collected fee amount is paid into the state budget.
