What are procedures for issuance of driver education provider licenses in Vietnam from January 1, 2025?
Based on Article 19 of Decree 160/2024/ND-CP (effective January 1, 2025), the procedure for issuing a Driver education provider license is stipulated as follows:
(1) After completing the establishment of infrastructure and the teaching staff meets the conditions of the car driving training facility, the organization or individual shall prepare one application dossier for licensing and submit it directly or via postal service to the Department of Transport;
(2) In case the dossier is not complete as per regulations, within no more than 02 working days from the date of receipt, the Department of Transport must provide written guidance for the organization or individual to complete the dossier;
(3) Within no more than 10 days from the date of receiving the complete and valid dossier as required, the Department of Transport shall conduct an on-site inspection of the training facility, prepare a report according to the form specified in Appendix XIII attached to Decree 160/2024/ND-CP, and issue a training license to facilities meeting the conditions. In cases where the license is not issued, a written response stating the reasons must be provided;
(4) The results will be delivered at the headquarters of the competent authority issuing the license or via postal service; for electronic driving training licenses, the Department of Transport will publish them on the Department's website for the training facility to print or save on electronic devices.
(5) Within 05 working days from the day the Department of Transport issues the driving training license, it must send the Directorate for Roads of Vietnam the management code of the car driving training facility, a copy of the driving training license along with the inspection report of the training facility.
(6) Within no more than 01 working day from the date of issuing the driving license for the training facility, the Department of Transport must issue a learner driver permit. In cases where it is not issued, a written response stating the reasons must be provided.
- The results will be delivered at the headquarters of the competent authority or via postal service; for electronic learner driver permits, the Department of Transport will publish them on the website for the training facility to print or store on electronic devices;
- The Department of Transport shall maintain a Register for issuing learner driver permits according to the form specified in Appendix IX attached to Decree 160/2024/ND-CP.

What are regulations on fee payers for driving tests in Vietnam?
Based on Article 2 of Circular 37/2023/TT-BTC which regulates the organization collecting fees and individuals paying for fees, the following is stipulated:
Organization collecting fees and individuals paying for fees
1. Individuals paying for fees are organizations or individuals who submit an application to the agency defined in Clause 2 of this Article for execution of the tasks specified for fee collection as follows:
a) Issuance of registration certificates, special-use motorbike plates.
b) Issuance of permits or certificates for activities on various vehicles.
c) Examination for issuance of road motor vehicle driving licenses.
2. The organization collecting fees specified in this Circular includes: the Directorate for Roads of Vietnam and road management authorities of provinces and centrally governed cities.
Thus, individuals or organizations paying for fees for driving tests are those submitting an application to the Directorate for Roads of Vietnam and road management authorities of provinces and centrally governed cities for executing the tasks specified for fee collection as follows:
- Issuance of registration certificates, special-use motorbike plates.
- Issuance of permits or certificates for activities on various vehicles.
- Examination for issuance of road motor vehicle driving licenses.
What are regulations on management and use of fees for driving tests in Vietnam?
Based on Article 5 of Circular 37/2023/TT-BTC regarding the management and use of fees for driving tests, the regulation is as follows:
- The organization collecting fees must remit 100% of the fees collected into the state budget. The operating costs for providing services and collecting fees shall be allocated from the state budget within the budget estimates of the organization collecting fees according to state budget policies and expenditure norms as prescribed by law.
- In cases where the organization collecting fees is allowed to retain operating costs from collected fee revenues according to Clause 1 Article 4 of Decree 120/2016/ND-CP, they may retain 75% of the fees collected to cover the costs of providing services and collecting fees as prescribed in Article 5 of Decree 120/2016/ND-CP; and remit 25% of the fees collected to the state budget.
In locations facing difficulties regarding physical conditions that have not yet built facilities meeting the physical conditions but are authorized by the Ministry of Transport to conduct examinations at old centers or sites, the organization collecting fees may retain 40% of the fees collected to cover the costs of providing services and collecting fees according to Article 5 of Decree 120/2016/ND-CP; and remit 60% of the fees collected to the state budget.
