Step 1: Prepare the application dossier, including the employment report (Form 01/PLI, as stipulated in Annex I of Decree 145/2020/ND-CP).

Step 2: Submit the dossier directly in the following specific cases:

- General case: Submit the dossier to the Department of Labor, Invalids, and Social Affairs, and notify the district-level social insurance agency where the enterprise’s headquarters or representative office is located.

- Case of workers in industrial parks, economic zones: Submit the dossier to the Department of Labor, Invalids, and Social Affairs, the district-level social insurance agency, and the Management Board of Industrial Parks and Economic Zones where the enterprise operates.

- Case of workers in high-tech zones: Submit the dossier to the Management Board of High-Tech Zones.

When is the deadline for the submission of the employment report in the last 6 months of the year in Vietnam?

According to Clause 2 and Clause 4 of Article 4 in Decree 145/2020/ND-CP, as amended by Clause 1, Article 73 of Decree 35/2022/ND-CP and supplemented by Clause 1, Article 49 of Decree 10/2024/ND-CP, it is stipulated as follows:

If the employer cannot report changes in employment via the National Public Service Portal, they should submit a paper report using Form 01/PLI, Annex I issued with this Decree to the Department of Labor, Invalids, and Social Affairs and notify the district-level social insurance agency where the headquarters, branch, or representative office is located. For workers in industrial parks and economic zones, the employer must report changes in employment to the Department of Labor, Invalids, and Social Affairs, the district-level social insurance agency where the headquarters, branch, or representative office is located, and the Management Board of Industrial Parks and Economic Zones for monitoring purposes.

The Department of Labor, Invalids, and Social Affairs is responsible for compiling information on employment changes when employers submit paper reports to ensure complete information updates using Form 02/PLI, Annex I issued with this Decree.

What is the union fee rate for officials who are union members in Vietnam?

According to Clause 1, Article 23 of Decision 1908/QD-TLD, specific regulations on the subjects, rates, and salary basis for union fee contributions are as follows:

Members in grassroots unions at state agencies; political organizations, political-social organizations, political-social-professional organizations, social organizations, social-professional organizations; units under the people's armed forces; public service providers receiving salaries based on salary tables and levels prescribed by the State: the monthly union fee is 1% of the salary basis for social insurance contributions according to the provisions of the law on Social Insurance.

The salary basis for social insurance contributions is the rank salary, position salary, salary according to labor contracts, work contracts, and additional allowances for positions, overtime allowance, professional seniority allowance. When the salary basis for social insurance contributions changes, the salary basis for union fee contributions will change according to the provisions of the law on Social Insurance.
