What are licensing fee rates for household businesses in Vietnam in 2024?

Based on Clause 2, Article 4 of Circular 302/2016/TT-BTC amended by Clause 3, Article 1 of Circular 65/2020/TT-BTC, the licensing fee that a household business must bear in 2024 is regulated as follows:

- Individuals, groups of individuals, and households with annual revenue over 500 million VND: 1,000,000 (one million) VND/year;

- Individuals, groups of individuals, and households with annual revenue over 300 to 500 million VND: 500,000 (five hundred thousand) VND/year;

- Individuals, groups of individuals, and households with annual revenue over 100 to 300 million VND: 300,000 (three hundred thousand) VND/year.

*Note:

Individuals, groups of individuals, households, production, and business locations (not exempt from the licensing fee) should pay the full annual licensing fee if commencing business in the first 6 months of the year, and 50% of the annual licensing fee if commencing in the last 6 months of the year.

What are the conditions for issuing a household business registration certificate in Vietnam?

Based on Clause 1, Article 82 of Decree 01/2021/ND-CP, the conditions for issuing a household business registration certificate are as follows:

Household Business Registration Certificate

1. A Household Business Registration Certificate is issued to household businesses established and operating in accordance with this Decree. A household business is issued a certificate when the following conditions are met:

a) The registered business lines is not prohibited from business investment;

b) The name of the household business is in accordance with the stipulations of Article 88 of this Decree;

c) A valid household business registration dossier is provided;

d) The required registration fee for household business registration is fully paid.

2. The Household Business Registration Certificate is issued based on information in the household business registration dossier declared and self-responsibly submitted by the founder of the household business.

3. Information in the Household Business Registration Certificate is legally valid from the date of the certificate's issuance, and the household business is entitled to operate from the date of issuance, except for businesses with conditional investment and business lines or professions. If the household business registers a start date of business operations after the certificate's issuance, it has the right to operate from the registered start date, except for conditional investment and business lines or professions.

4. The household business can receive the Household Business Registration Certificate directly at the district-level business registration agency or register and pay to receive it by mail.

5. The household business is entitled to request a certified copy of the Household Business Registration Certificate from the district-level business registration agency and pay the prescribed fee.

Thus, the conditions for a household business to be issued a business registration certificate include:

- The registered business lines is not prohibited from business investment.

- The name of the household business is in accordance with the stipulations of Article 88 Decree 01/2021/ND-CP.

- A valid household business registration dossier is provided.

- The required registration fee for household business registration is fully paid.

What are regulations on business lines of a household business in Vietnam?

Based on Article 89 of Decree 01/2021/ND-CP, the business lines of a household business are regulated as follows:

- When registering establishment or changes in registration content, household businesses declare their business lines on the Household Business Registration Request Form, Notice of Changes in Registration Content. The district-level business registration agency records this information on the Household Business Registration Certificate.

- Household businesses can conduct business in fields with conditional investment and business lines or professions from the time they meet legal requirements and must ensure compliance with those conditions throughout operation. Management of state-level requirements for conditional business lines or professions and inspection of business requirements compliance by household businesses falls under the jurisdiction of specialized agencies as stipulated by specialized law.

- If the district-level business registration agency receives documentation from competent authorities that a household business is operating in a conditional investment and business lines but does not meet legal conditions, the agency will issue a Notice requiring the household business to temporarily suspend operations until conditions are met and inform the competent state authority for handling as per legal stipulations.
