Vietnam: What does the application for participation in the allocation of sugar import tariff quotas via auctions include?
Based on the provisions in Clause 1, Article 11 of Circular 11/2022/TT-BCT, each trader shall submit one application for participation in the allocation of sugar import tariff quotas via auctions, which includes:
(i) Price Bid (as per the Form in the Appendix issued with Circular 11/2022/TT-BCT).
Each trader may bid with a registered price either identical or different for one unit price and a maximum registered quantity not exceeding 20 (twenty) unit prices. Each unit price has a registered quantity of 1,000 (one thousand) tons.
The price bid is placed in a separate sealed envelope bearing the trader’s signature at the edges and included in the application for participation in the allocation of sugar import tariff quotas via auctions. This price bid is only opened at the Auction Session.
(ii) Business registration certificate or enterprise registration certificate or investment certificate or equivalent documents: 01 copy, certified and stamped as a true copy by the trader.
(iii) Document confirming the payment of the deposit into the account of the Ministry of Industry and Trade: 01 copy, certified and stamped as a true copy by the trader.

2. The application for participation in the allocation of sugar import tariff quotas via auctions must be sealed, with a stamp, and clearly state on the outside of the dossier the following contents:
a) application for participation in the allocation of sugar import tariff quotas via auctions.
b) Name of the trader.
c) Detailed contact information of the trader (address, phone number, fax number, email address).
- Place and time of receiving the dossier
a) After the announcement of the Auction Session, traders send the dossier as stipulated in Clauses 1 and 2 of this Article either by post or directly to the permanent section of the Auction Council (Import-Export Department - Ministry of Industry and Trade, address 23 Ngo Quyen, Hoan Kiem, Hanoi).
b) The time for receiving the dossier is announced in the Notice inviting participation in the allocation of sugar import tariff quotas via auctions.
c) The time of receiving the dossier is based on the received stamp of the Ministry of Industry and Trade.
According to the above regulations, the application for participation in the allocation of sugar import tariff quotas via auctions must be sealed, with a stamp.
The outside of the application for participation in the allocation of sugar import tariff quotas via auctions must clearly state the following contents:
- application for participation in the allocation of sugar import tariff quotas via auctions.
- Name of the trader.
- Detailed contact information of the trader (address, phone number, fax number, email address).
What are procedures for assessment of the application for participation in the allocation of sugar import tariff quotas via auctions in Vietnam?
Based on the provisions in Article 12 of Circular 11/2022/TT-BCT regarding the assessment of the application for participation in the allocation of sugar import tariff quotas via auctions as follows:
The Auction Council checks and evaluates the dossiers and notifies the traders of the assessment results: eligibility for participation, need for dossier supplementation, or non-eligibility for participation.
(1) The Auction Council notifies traders eligible to participate in the allocation of sugar import tariff quotas via auctions at least 02 (two) working days before the Auction Session (can be notified via written document or email, fax).
(2) In case dossier supplementation is required, the Auction Council notifies the trader to submit supplementary documents to the permanent section of the Auction Council no later than 03 (three) working days before the Auction Session (can be notified via written document or email, fax).
(3) In case of non-eligibility to participate in the auction, the Auction Council notifies the trader no later than 03 (three) working days before the Auction Session (can be notified via written document or email, fax).
