Vietnam: Dispatch 24 issued to arrange the specialized agencies at the provincial and district levels to implement Resolution 18 for downsizing the organizational structure?
On December 18, the Steering Committee of Vietnam for summarizing the implementation of Resolution 18-NQ/TW of the Government of Vietnam issued Official Dispatch 24/CV-BCDTKNQ18 ...Download regarding the orientation and suggestions for arranging the organization of specialized agencies within the district-level People's Committee.
To be specific, for specialized agencies under the district-level People's Committee, maintain 03 Specialized Departments, including: Department of Justice; Department of Finance — Planning; District Inspectorate; Office of the People's Council and the district-level People's Committee.
The orientation and suggestions for the restructure, arrangement, and re-organization of other Specialized Departments are to be aligned with the arrangement of Ministries at the central level and Departments and branches at the provincial level. Specifically:
(1) Merge the Department of Labor, Invalids, and Social Affairs with the Department of Internal Affairs.
Regarding the name after the merger, it is proposed to be the Department of Internal Affairs and Labor.
Regarding functions and tasks: The Department of Internal Affairs and Labor will assume the functions and tasks of the Internal Affairs Department and the functions and tasks related to labor, wages; employment; individuals with meritorious service; occupational safety and hygiene; social insurance; gender equality from the current Department of Labor, Invalids, and Social Affairs.
(2) Establish the Department of Economy, Infrastructure, and Urban based on absorbing the functions and tasks for state management advice on construction, transportation, industry, and trade within the district from the current Department of Economy and Urban Management (at the district-level town, city), Department of Economy and Infrastructure (at the district).
(3) Establish the Department of Culture, Science, and Information by absorbing the functions and tasks of the Department of Culture - Information and the functions and tasks regarding science and technology from the current Department of Economy (at the district-level town, city), Department of Economy and Infrastructure (at the district) at the district level.
(4) Establish the Department of Agriculture and Environment based on absorbing the functions and tasks of the Department of Natural Resources and Environment and the functions and tasks of the Department of Agriculture and Rural Development (at the district) and functions and tasks regarding agriculture and rural development from the current Department of Economy (at district-level town, city) at the district, district-level town, city under the province.
Specifically, in districts, maintain the Department of Natural Resources and Environment and absorb the functions and tasks regarding disaster prevention from the current Department of Economy.
(5) Department of Health: Arrange suitably to the situation and characteristics of the agency at the locality as follows:
For localities currently having a Department of Health, assign this Department to absorb the functions of state management advice regarding social protection, children's affairs, and preventing social evils from the current Department of Labor, Invalids, and Social Affairs.
For localities that have merged the Department of Health into the Office of the People's Council and the district-level People's Committee, based on the situation and characteristic of the agency at the locality, decide to assign the Office to absorb state management advice functions regarding social protection, children's affairs, and preventing social evils from the current Department of Labor, Invalids, and Social Affairs or establish a Department of Health to perform these functions and absorb state management advice regarding those fields from the current Department of Labor, Invalids, and Social Affairs.
(6) The Department of Education and Training shall absorb the functions and tasks regarding vocational education from the current Department of Labor — Invalids and Social Affairs.
(7) Department of Ethnic Affairs: Implement similarly as at the provincial level.
Regarding implementation, it is proposed that party committees and leadership organizations at localities direct their agencies and units to develop Schemes to arrange and downsize the organizational structure in accordance with Central Government, Politburo, Central Steering Committee of Vietnam, and the Government of Vietnam Steering Committee of Vietnam orientations and suggestions; carefully prepare personnel plans, policies, premises, finances, assets, equipment, seals, and other necessary conditions for immediate implementation upon approval by the Central Government and National Assembly (the Central Government and National Assembly are expected to convene in February 2025).
District-level People's Committees shall direct the Department of Internal Affairs to lead and cooperate with Specialized Departments to develop plans for arranging specialized agencies under the district-level People's Committee, to present to competent authorities for review and decision.
Localities should direct specialized agencies at the provincial and district levels to actively cooperate with relevant agencies to draft Decisions defining functions, tasks, authority, and organizational structure of their agencies for submission to competent authorities for issuance immediately after receiving unified guidance from the Government of Vietnam, ensuring conditions for district party congresses.
Implementation timeframe: Localities complete the arrangement of specialized agencies under the provincial, district-level People's Committees, ensuring synchronization with completing the downsizing and reorganization of the Government of Vietnam (expected to be completed by February 20, 2025, and report the results to the Ministry of Internal Affairs before February 28, 2025).

What tasks are the Ministry of Finance of Vietnam in charge of assisting the Government of Vietnam?
Based on clause 1, Article 15 of the Law on Tax Administration 2019, the Ministry of Finance of Vietnam is designated as the lead agency in assisting the Government of Vietnam with the unified state management of tax administration and has the following tasks and powers:

- Coordinate with the Ministry of Planning and Investment and other relevant Ministries in guiding the implementation of independent assessment of the value of machinery, equipment, and technology lines as prescribed.
