Official of Decree 178 on policies for Vietnamese officials during downsizing implemented in Vietnam?
On December 31, 2024, the Government of Vietnam promulgated policies concerning Vietnamese officials and public employees, workers, and the armed forces in implementing the downsizing of the political system's machinery.
To be specific, Decree 178/2024/ND-CP stipulates policies including:
- Policies for those who retire or resign;
- Policies for those who cease holding leadership, managerial positions, or are elected, appointed to lower leadership and managerial roles;
- Policies enhancing assignments at grassroots levels; policies of valuing individuals with outstanding qualities and capabilities;
- Policies for training and improving the proficiency of Vietnamese officials and public employees after rearrangement.
Moreover, from Article 17 to Article 23, Decree 178/2024/ND-CP provides regulations on the responsibilities to implement policies for Vietnamese officials and public employees and workers in agencies, organizations, and units of the Communist Party, the State, the Vietnam Fatherland Front, political-social organizations from central to district levels, for these subjects:
- Vietnamese officials at the commune level;
- Armed forces (including the People's Army, the People's Public Security, and cipher) during the process of organizing the political system's machinery, administrative units at various levels, including:
+ Agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, and central political-social organizations;
+ Commune-level Vietnamese officials and the armed forces;
+ Public service providers under the organizational structure of advisory agencies working for the Central Committee, the Politburo, the Secretariat; central ministries and authorities; agencies at the central level; under provincial People's Committees and specialized agencies of provincial and district-level People's Committees.
+ Other public administrative units (not specified in (ii)) completing the reorganization or staff restructuring within 12 months from the effective date of the decision by competent authority.
Additionally, Article 3 of Decree 178/2024/ND-CP stipulates the implementation of policies for Vietnamese officials, public employees, workers, and armed forces in the process of restructuring the political system must adhere to the following principles:
- Ensuring the leadership of the Communist Party, promoting the supervising role of the Vietnam Fatherland Front and political-social organizations and the people during policy implementation.
- Guaranteeing principles of democratic centralism, objectivity, fairness, transparency, and legal compliance.
- Ensuring that no later than 5 years from the effective date of the organizational restructuring decision, the number of leadership, management, and staff in organizations within the political system will conform to the requirements.
- Ensuring prompt and full policy payment as per legal regulations; effectively using state budget funds.
- Each agency, organization, and unit must review and evaluate its Vietnamese officials and public employees, and workers with impartiality and objectivity, based on the assessment of qualities, capabilities, task performance results, and job requirements; based on that, execute downsizing and policies for Vietnamese officials and public employees, and workers.
- The collective leadership of the party committee, government, and the head of agencies, organizations, units are responsible for the evaluation, filtering, selection of the retirement target linked with restructuring and improving the quality of Vietnamese officials and public employees, within their management scope to enhance operational efficiency, effectiveness.
- An eligible individual entitled to multiple policies under different documents shall only receive the highest benefit.
- Ministries, central committees, and agencies, organizations, and units at the provincial level must assign approximately 5% of their staff to work at grassroots level.

As per clause 1 Article 9 of Circular 29/2022/TT-BTC, the senior tax inspector is the official with the highest professional level in the field of taxation, positioned for leadership titles at Directorate levels, Department, Bureau, or equivalent, responsible for advising on state management duties regarding taxes at the General Department of Taxation and provincial tax departments, executing tax tasks at high complexity within a province, several provinces, or nationwide.
(2) Principal Tax Inspector:
Based on clause 1 Article 10 of Circular 29/2022/TT-BTC, the principal tax inspector is an official with a high professional level in taxation, assisting leadership in organizing and implementing tax administration or directly performing tax inspection tasks according to their assigned function within tax sector entities.
(3) Tax Inspector
According to clause 1 Article 11 of Circular 29/2022/TT-BTC, the tax inspector is an official with a basic professional level in taxation; directly executing tasks for tax management operations.
(4) Junior Tax Inspector
According to clause 1 Article 12 of Circular 29/2022/TT-BTC, the junior tax inspector is tasked with executing specialized taxation operations; directly handling a portion of tax management duties in the unit.
(5) Tax Officer
According to clause 1 Article 13 of Circular 29/2022/TT-BTC, the tax officer is an official performing simple administrative tasks in the field of taxation; directly handling portions of tax management tasks as assigned by the unit.
What are the general standards for Vietnamese tax officials' qualities?
According to Article 4 of Circular 29/2022/TT-BTC, the specific standards for qualities are as follows:
(1) Mastering the policies and guidelines of the Communist Party; loyal to the Fatherland, the Party, and the State; protecting the interests of the nation and the people.
(2) Fully performing the duties of an official according to the law; strictly complying with task assignments from superiors; adhering to laws, discipline, administrative order; and exemplary adherence to internal rules and regulations.
(3) Dedicated, responsible, honest, impartial; with proper demeanor and cultural behavior in duty performance, standard communication in serving the people;
(4) Having a healthy lifestyle, modesty, solidarity; diligent, thrifty, honest, unbiased; not abusing public office for personal gain; avoiding bureaucratic, corrupt, wasteful, and negative behavior.
(5) Regularly learning and improving personal qualities, expertise, and capabilities.
