Is the Thanh Minh Festival 2025 a holiday for Vietnamese tax officials?
According to Article 112 of the Labor Code 2019, which stipulates the holidays where employees are entitled to leave with full pay:
Holidays, New Year
- Employees are entitled to leave work with full pay on the following holidays:
a) New Year’s Day: 01 day (January 1 in the Gregorian calendar);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30 in the Gregorian calendar);
d) International Labor Day: 01 day (May 1 in the Gregorian calendar);
đ) National Day: 02 days (September 2 in the Gregorian calendar and 01 adjacent day before or after it);
e) Hung Kings Commemoration Day: 01 day (10th day of the 3rd lunar month).
- Foreign employees working in Vietnam, in addition to the holidays prescribed in Clause 1 of this Article, are entitled to an additional day off on their national traditional New Year and their national day.
- Annually, based on actual conditions, the Prime Minister of the Government of Vietnam shall specifically decide on the days off prescribed at Point b and Point đ, Clause 1 of this Article.
Thus, the Thanh Minh Festival 2025 is not stipulated as a holiday during which Vietnamese tax officials are entitled to leave with full pay.
However, Vietnamese tax officials can still request leave on this day by the following methods:
(1) Leave of absence
According to Article 114 of the Labor Code 2019, employees have 12 - 16 days of leave per year if they work full-time. Therefore, if Vietnamese tax officials still have leave days or can advance leave days, they can use paid leave to visit ancestral graves during the Thanh Minh Festival 2025.
(2) Accumulated leave
Based on Clause 4, Article 113 of the Labor Code 2019, Vietnamese tax officials can negotiate with their agency or superiors to accumulate their leave for several times or up to a maximum of 03 years/occasion.
In cases where superiors agree to the accumulated leave, Vietnamese tax officials are paid in full during these leave days.
(3) Unpaid leave
Vietnamese tax officials can negotiate with their agency, and their superiors to be allowed unpaid leave if they have exhausted their annual leave days or wish to save their leave days.
Note: The request for additional leave by accumulating leave or taking unpaid leave must have the agreement and approval of superiors or the working agency; unauthorized absence is considered as voluntarily leaving the job.

According to Section 1 of Official Dispatch 3821/TCT-KTNB of 2024 rectifying the use of social media in agencies issued by the General Department of Taxation:
Social media is a useful tool for people to communicate, share information quickly, efficiently, and conveniently. However, improper use can cause unforeseeable consequences for the individual and the organization where the social media user works.
Recently, the General Department of Taxation has received several complaints about Vietnamese tax officials posting inappropriate information on social media. To enhance the awareness of compliance with social media usage regulations among officials, public employees, and workers across the sector, the General Department of Taxation requires Heads of Tax Departments in provinces, centrally run cities, Heads of Departments/units of the General Department of Taxation to implement:
1. Disseminating to all officials, public employees, and workers across the sector to strictly comply with the Code of Conduct on social media issued with Decision No. 847/QD-BTTTT dated June 17, 2021, of the Ministry of Information and Communications.

Additionally, based on Article 3 of the Code of Conduct on social media issued with Decision 847/QD-BTTTT of 2021, the common conduct rules for Vietnamese tax officials on social media are as follows:
Rule 1. Respect and legal compliance rule: Comply with Vietnamese law, respect the legitimate rights and interests of organizations and individuals.
Rule 2. Healthy conduct rule: Behavior on social media must align with the ethical, cultural, and traditional values of the Vietnamese nation.
Rule 3. Safety and information security rule: Adhere to regulations and guidelines on protecting safety and information security.
Rule 4. Responsibility rule: Be responsible for actions and behaviors on social media; cooperate with functional agencies to handle actions, content, and information violating the law.
