On December 5, 2024, the Steering Committee for the Summary of the Implementation of Resolution 18-NQ/TW adopted Plan 140/KH-BCDTTNQ18 regarding the orientation plan for arranging and downsizing the organizational structure of the Government of Vietnam.

The orientation plan for arranging the organizational structure of ministries and ministry-equivalent agencies under the Government of Vietnam is as follows:

- Maintain 08 Ministries, ministerial-level agencies (with internal reorganization and downsizing):

+ For the Ministries, includes: Ministry of National Defense; Ministry of Public Security; Ministry of Justice; Ministry of Industry and Trade; Ministry of Culture, Sports and Tourism.

+ For the ministerial-level agencies, includes: Government Office; (2) Government Inspectorate; State Bank of Vietnam.

The proposal to maintain the aforementioned Ministries and ministerial-level agencies is necessary, ensuring stability, inheritance, and suitability with current practical requirements.

Consolidation and rearrangement of ministries:

The Ministry of Planning and Investment will merge with the Ministry of Finance of Vietnam, with the proposed name being the Ministry of Finance of Vietnam and Development Investment or Ministry of Economic Development.

The Ministry of Transport will merge with the Ministry of Construction, potentially named the Ministry of Infrastructure and Urban Development.

The Ministry of Natural Resources and Environment will merge with the Ministry of Agriculture and Rural Development, proposed to be renamed the Ministry of Agriculture, Natural Resources and Environment, to solve overlapping in water resource management and biodiversity.

The Ministry of Information and Communications will merge with the Ministry of Science and Technology, possibly named the Ministry of Digital Transformation and Science, Technology.

The Ministry of Labor, Invalids and Social Affairs will merge with the Ministry of Home Affairs, creating the Ministry of Home Affairs and Labor. Some functions of the Ministry of Labor will be transferred to the Ministry of Education and Training and the Ministry of Health.

Adjustment of functions and tasks:

The Ministry of Health will undertake duties regarding social protection, children, and social vice prevention. It will also manage the current functions of the Central Health Protection and Care Committee when this unit is dissolved.

The Ministry of Foreign Affairs will assume the duties of the Central External Relations Committee and the National Assembly's Foreign Affairs Committee after these units cease operations.

The Ministry of National Defense will adjust its internal organizational structure and take over the Ho Chi Minh Mausoleum Management Board.

Arrangement of Government agencies:

Some units, such as the Committee for State Capital Management at Enterprises and the National Financial Supervisory Committee, will cease operations.

Two academies and two national universities (Hanoi and Ho Chi Minh City) will be reorganized.

Towards downsizing the organizational structure:

It is expected that the organizational structure of the Government of Vietnam will be reduced to 13 ministries and 4 ministerial-level agencies, a reduction of 5 ministries compared to the current structure.

Reduce 15-20% of internal organizational units in ministries, except in the Ministry of Public Security and the Ministry of National Defense.

Establish new party committees:

The Communist Party Personnel Committee of the Government of Vietnam will cease operations, to be replaced by the Communist Party Committee of the Government of Vietnam under the Central Government. Party organizations of ministries and ministerial-level agencies will fall under this party committee.

The organizational realignment of the Government of Vietnam aims to fulfill the goal of "Compact - Lean - Strong - Efficient - Effective" and meet the requirements for building a socialist rule of law state in the new era. The Minister of Home Affairs emphasized that this is an important step forward in enhancing management efficiency, reducing overlapping functions, and promoting the country's sustainable development.

Based on Clause 1, Article 15 of the Law on Tax Administration 2019, specific provisions concerning the duties, powers, responsibilities of Ministries, ministerial-level agencies, and Government agencies are as follows:

The Ministry of Finance of Vietnam is the leading agency assisting the Government of Vietnam in unified state management of tax administration with the following duties and powers:

- Issue or submit for issuance within its authority, or for competent authorities to issue legal documents on tax administration;

- Organize the implementation of tax administration as per the Law on Tax Administration 2019 and other related laws;

- Organize the formation and execution of the state budget revenue forecasts;

- Conduct inspection and audit of tax law implementation and other related laws;

- Handle legal violations and resolve complaints, denunciations related to tax law implementation within its authority;

- Organize international cooperation in taxation;

- Coordinate with the Ministry of Planning and Investment and other Ministries in guiding independent valuation of machinery, equipment, technology lines as stipulated.

What tasks are assigned to the Ministry of Finance of Vietnam in Plan 140?

According to Plan 140/KH-BCDTTNQ18, the specific provisions are as follows:

- Assign the Ministry of Finance of Vietnam to develop the scheme for merging the Ministry of Planning and Investment and the Ministry of Finance of Vietnam; reorganize, restructure, and significantly reduce internal organizations to perform functions, duties, and powers after merging into the Ministry of Finance of Vietnam and Development Investment or Ministry of Economic Development.

- Assign the Ministry of Finance of Vietnam to lead and cooperate with the Committee for State Capital Management at Enterprises to receive 19 state corporations, general companies into the Ministry of Finance of Vietnam and Development Investment (or Ministry of Economic Development) and develop a plan; proactively research and develop a plan to establish a Communist Party committee for some major corporations as the focal point party organization under the Communist Party committee of the Government of Vietnam.
