How much is the fine for failing to wear a helmet in Vietnam according to Decree 168?

Below are the traffic violation fines for failing to wear a helmet according to Decree 168/2024/ND-CP:

(1) Motorcycles/motorbikes/types of vehicles similar to motorbikes

According to Article 7 of Decree 168/2024/ND-CP, regulations are in place for fines and point deductions from driving licenses for operators of motorcycles, motorbikes, and similar vehicles that violate traffic rules on roadways as follows:

  1. A fine ranging from 400,000 VND to 600,000 VND for operators committing one of the following violations:

h) failing to wear a “helmet for motorbike riders” or wearing a “helmet for motorbike riders” without properly securing the strap while operating a vehicle on roadways;

i) Carrying passengers who do not wear a “helmet for motorbike riders” or wearing a “helmet for motorbike riders” without properly securing the strap, except in cases of transporting patients for medical emergencies, children under 6 years old, or escorting persons who have violated the law;

Thus, operators will be fined from 400,000 VND to 600,000 VND for the following actions:

- failing to wear a helmet or not securing the helmet strap correctly while operating the vehicle on roadways;

- Carrying passengers who do not wear helmets or do not secure the helmet strap correctly for passengers,

Note: Except in cases of transporting patients for medical emergencies, children under 6 years old, or escorting persons who have violated the law;

(2) Bicycles/electric bicycles/other rudimentary vehicle operators

According to Article 9 of Decree 168/2024/ND-CP, regulations on fines for operators of bicycles, electric bicycles, and other rudimentary vehicles that violate traffic rules on roadways are as follows:

d) Operators of electric bicycles failing to wear a “helmet for motorbike riders” or wearing a “helmet for motorbike riders” without properly securing the strap while participating in traffic on roadways;

dd) Carrying passengers on electric bicycles who do not wear a “helmet for motorbike riders” or wearing a “helmet for motorbike riders” without properly securing the strap, except in cases of transporting patients for medical emergencies, children under 6 years old, or escorting persons who have violated the law.

Thus, operators will be fined from 400,000 VND to 600,000 VND for the following actions:

- Electric bicycle operators failing to wear helmets or not securing the helmet strap correctly while participating in traffic on roadways;

- Carrying passengers on electric bicycles who do not wear helmets or do not secure the helmet strap correctly

Note: Except in cases of transporting patients for medical emergencies, children under 6 years old, or escorting persons who have violated the law;

Are electric bicycles subject to excise tax in Vietnam?

Pursuant to Article 2 of the Law on excise tax 2008 (amended by Clause 1 Article 1 of the Law on excise tax Amendment 2014), the subject to tax is specified as follows:

Subjects subject to tax

  1. Goods:

a) Cigarettes, cigars, and other products derived from tobacco plants used for smoking, inhaling, chewing, smelling, sucking;

b) Alcohol;

c) Beer;

d) Automobiles with less than 24 seats, including those that carry both passengers and goods with more than two rows of seats and have a fixed partition between the passenger compartment and the cargo compartment;

dd) Two-wheeled, three-wheeled motorcycles with a cylinder capacity over 125 cm3;

e) Aircraft, yachts;

g) Various types of petrol;

h) Air conditioners with a capacity of 90,000 BTU or less;

i) Playing cards;

k) Votive papers/products.

  1. Services:

a) Nightclub business;

b) Massage business, karaoke business;

c) Casino business; electronic gaming with prizes including games by jackpot machines, slot machines, and similar machines;

d) Betting business;

đ) Golf business including the sale of memberships, golf tickets;

e) Lottery business.

Thus, according to the aforementioned regulations, electric bicycles are not subject to excise tax.

Is the import of bicycles for business subject to registration fee in Vietnam?

Pursuant to Article 3 of Decree 10/2022/ND-CP, the regulations on registration fees are as follows:

Subjects liable to registration fees

  1. Houses, land.
  1. Hunting rifles; guns used for training, competition.
  1. Ships as prescribed by the law on inland waterway traffic and maritime law (hereafter referred to as watercraft), including barges, speedboats, tugboats, pushers, submarines, submersibles; excluding floating docks, floating storage and mobile rigs.
  1. Boats, including yachts.
  1. Aircraft.
  1. Two-wheeled motorbikes, three-wheeled motorbikes, motor vehicles, types of vehicles similar to motorcycles, motor vehicles that must be registered and have a license plate issued by competent state agencies (commonly referred to as motor vehicles).
  1. Automobiles, trailers, or semi-trailers pulled by automobiles, types of vehicles similar to automobiles that must be registered and have a license plate issued by competent state agencies.
  1. The hull, chassis, engine block, body block of the properties stipulated in Clauses 3, 4, 5, 6, and 7 of this Article that are replaced and must be registered with competent state agencies.

The Ministry of Finance shall detail this Article.

Thus, according to the above regulations, ordinary bicycles or even those imported for business purposes are not subject to registration fees.
