From January 1, 2025, which entities are exempt from road user charges at toll plazas in Vietnam?

Based on Article 3 of Circular 32/2024/TT-BGTVT (effective from January 1, 2025), there are 12 entities exempt from road user charges at toll plazas, including:

(1) Ambulances.

(2) Fire trucks belonging to the Fire and Rescue Police force and other fire trucks mobilized for firefighting duties with priority signals according to the law.

(3) Agricultural and forestry machinery including tractors, plows, tillers, weeders, and threshers.

(4) Special-purpose vehicles for national defense, including vehicles with number plates: red background, white embossed letters and numbers, equipped with special defense equipment, and vehicles on urgent missions using one of the priority signals as per legal regulation in emergency cases.

(5) Special-purpose vehicles of the public security force organization system, including:

- Traffic police patrol cars with specific features: rotating lights on the roof and the words “TRAFFIC POLICE” printed on both sides of the car.

- Police cars 113 with the words “POLICE 113” printed on both sides of the car.

- Riot police cars with the words “RIOT POLICE” printed on both sides of the car.

- Transport vehicles with seats installed inside for the public security force on missions.

- Prisoner transport vehicles, rescue vehicles, and other special-purpose vehicles of the public security force.

- Special vehicles (satellite communication vehicles, bulletproof vehicles, anti-terrorism, riot control vehicles, and other specialized vehicles of the public security force).

- Public security force vehicles on urgent missions using priority signals according to the law.

(6) Special-purpose vehicles for funerals, including:

- Vehicles specifically designed for funeral services.

- Funeral service vehicles solely used for funeral activities with vehicle registration certificates under the name of the funeral service unit. The funeral service unit must make a declaration of commitment that these vehicles are only used for funeral activities and send it to the electronic payment service provider.

(7) Convoys with traffic police guidance.

(8) National defense vehicles participating in exercises, mobile force movements, weapons, and equipment transportation with military specialized vehicles leading the way.

(9) Automobiles of the police and national defense forces using nationwide road user charge tickets according to regulations.

(10) Dike protection vehicles; vehicles on emergency missions for flood and storm prevention under competent authority directions.

(11) Vehicles on missions transporting medicines, machinery, equipment, materials, and goods to disaster-stricken areas or epidemic zones as per law on emergency status during a major disaster or dangerous epidemic.

(12) Motorbikes, mopeds, and rudimentary vehicles.

How to determine the road user charge when vehicles pass through toll plazas in Vietnam?

Based on Article 5 of Decree 90/2023/ND-CP, the road user charge is determined as follows:

- The road user charge is stipulated in Appendix 1 issued with Decree 90/2023/ND-CP.

- In cases where the fee amount is an odd amount, the toll collection organization rounds down for fees below 500 VND and rounds up to 1,000 VND for fees between 500 VND to less than 1,000 VND.

Which organizations are authorized to collect road user charges in Vietnam?

According to Article 4 of Decree 90/2023/ND-CP, organizations authorized to collect road user charges include:

- The Vietnam Road Administration collects tolls for automobiles belonging to national defense and police forces.

- Vehicle registration units collect tolls for automobiles of entities and individuals registered in Vietnam (excluding vehicles of national defense and police forces). The Vietnam Register consolidates collected fees from vehicle registration units, declares, and submits fees according to regulations.

How to determine road user charges in Vietnam?

Pursuant to Article 4 of Circular 32/2024/TT-BGTVT, the pricing for road user charge is determined as follows:

- The maximum price for road user charge is determined based on the principles and bases stipulated in Article 22 of the Pricing Law 2023.

- The Vietnam Road Administration decides on applying the pricing method under legal regulations on pricing.

- When factors forming the price for road user charge change, affecting the maximum price of road user charge, the Vietnam Road Administration organizes the selection of Project Enterprises involved in road construction for business to develop a pricing plan.

- Selected Project Enterprises are responsible for developing pricing plans according to legal regulations on pricing, reporting, explaining the pricing plan, providing documents, and pricing plan files as required by the Vietnam Road Administration and are responsible for the pricing plans they develop.

- The Vietnam Road Administration is responsible for appraising the pricing plan, submitting it to the Ministry of Transport for issuing documents prescribing the maximum price for road user charge.

- The preparation, appraisal of pricing plan dossiers, issuance of pricing documents, or price adjustments are carried out according to legal regulations on pricing.
