From January 01, 2025, What are procedures for reconciliation of revenue and transfer of funds to the road user charge collection account in Vietnam?

Pursuant to Article 13 of Circular 34/2024/TT-BGTVT (document effective from January 01, 2025) regulating the reconciliation of revenue and transferring money to the road user charge collection account as follows:

(1) Reconciliation of highway toll revenue between the revenue management unit, the toll operation unit, and the road user charge payment service provider:

- The toll operation unit shall reconcile the highway toll revenue with the road user charge payment service provider as specified in (2);

- The revenue management unit shall review the activity and highway toll revenue of the toll operation unit and road user charge payment service provider to ensure accurate and adequate collection.

(2) Reconciliation of road usage service revenue among the revenue management unit, toll operation unit, and road user charge payment service provider:

- Based on data specified in Clause 3, Article 8 of Circular 34/2024/TT-BGTVT, the road user charge payment service provider shall reconcile daily road user charge revenue data immediately after the data closing point (24 hours from the previous data closing point) with the revenue management unit to verify the collected road user charge of the day. The data closing point is agreed upon in the toll service contract;

- By the 5th of each month, the road user charge payment service provider and revenue management unit shall reconcile and finalize the debt for the previous month;

- Within 30 days from the end of each financial year, the road user charge payment service provider and revenue management unit shall finalize the debt and settle accounts for the previous year.

(3) In cases where the road user charge payment service provider is also the toll operation unit, the road user charge payment service provider is responsible for organizing the reconciliation of toll revenue data as specified in (2) to ensure accurate and adequate collection.

(4) The road user charge payment service provider is responsible for developing reconciliation and fund transfer procedures in compliance with this Circular and laws on electronic road traffic payment and highway toll collection.

(5) The revenue management unit for toll stations collecting road usage service fees and the toll operation unit for toll stations collecting highway tolls are responsible for cooperating with the road user charge payment service provider to implement the reconciliation process and rectify, adjust any errors detected during the reconciliation process.

(6) The toll operation unit shall cooperate with the road user charge payment service provider to publicly disclose daily revenue and outstanding amounts owed by vehicles at each toll station.

What are regulations on transfer of road user charges and payment for service provision in Vietnam from January 01, 2025?

Pursuant to Article 14 of Circular 34/2024/TT-BGTVT regulating the transfer of road user charges and payment for service provision as follows:

(1) For highway toll fees

The road user charge payment service provider and revenue management unit shall carry out the transfer of collected road user charges and payment for service provision in accordance with the laws on highway toll collection.

(2) For road usage service fees:

- Based on the agreed data after daily revenue reconciliation with the revenue management unit, the road user charge payment service provider transfers the entire collected road user charge (including value-added tax) at each toll station to the revenue management unit. This is after deducting the road user charge service costs under the toll service contract. The transfer timing shall comply with laws on electronic road traffic payment;

- The road user charge payment service provider is responsible for developing a process for conducting road user charge transactions electronically without stopping; declaring and paying taxes on the part of the road usage service fee they receive.

How will data on road user charge collection be managed and used in Vietnam?

Pursuant to Article 10 of Circular 34/2024/TT-BGTVT regulates the management and utilization of road user charge data at toll stations as follows:

(1) The Vietnam Road Administration manages and utilizes road user charge data of toll stations on the electronic road traffic payment database management system; exploits transaction data of road usage payments through login and password access to the portal dedicated to governmental regulatory agencies on the Back-End system of the road user charge payment service provider.

(2) Provincial People's Committees organize the management and utilization of road user charge data from toll stations under local management on the electronic road traffic payment database management system; exploit transaction data regarding road usage payments from toll stations under local management through login and password access to the portal dedicated to governmental regulatory agencies on the Back-End system of the road user charge payment service provider.

(3) The road user charge payment service provider manages and utilizes road user charge data on the Back-End system according to the toll service contract and laws on electronic road traffic payment.

(4) Revenue management and toll operation units manage and utilize road user charge data in a single-lane collection method at toll stations within their management scope. Concurrently, they must synchronously connect transaction history data of road user charge collection in the single-lane method at toll stations to the Back-End system of the road user charge payment service provider.

(5) Revenue management and toll operation units are permitted to exploit data on road usage payment transactions from toll stations within their management scope through login access provided for entry into the Back-End system of the road user charge payment service provider.

(6) Vehicle owners can access road user charge data through a transportation account and the electronic road transportation payment application for vehicle owners on the Back-End system of the road user charge payment service provider.

(7) The management and utilization of road user charge data must comply with laws on electronic transactions, cybersecurity, information safety, and other relevant legal provisions.
