Conclusion 126 2025: Vietnam eliminates district-level courts and procuracies for downsizing

On February 14, 2025, the Central Executive Committee issued Conclusion 126-KL/TW in 2025...Download regarding certain content, tasks to continue arranging and downsizing the organizational apparatus of the political system in 2025.

To be specific, according to Conclusion 126 in 2025 regarding the task of continuing to arrange, and perfect the organizational apparatus of the political system in 2025 and the 2025-2030 term. The Politburo, Secretariat has tasked the Communist Party committees of the Central agencies to lead and direct the Communist Party committees of the Supreme People's Court, and the Communist Party committees of the Supreme People's Procuracy to perform the following tasks:

- Research and advise on the model of the agency (court, procuracy) oriented to eliminate intermediate levels (district level);

- Propose supplementation and amendments to the mechanisms and policies of the Communist Party, State laws concerned;

- Continue to renew the organization, improving the quality of activities of the people's courts and people's procuracies to meet the requirements of judicial reform in the new situation;

The above contents need to be reported to the Politburo in the second quarter of 2025.

Thus, research and advise on the model of the agency (court, procuracy) are oriented toward eliminating intermediate levels (district level).

How many types of Court fees are there in Vietnam?

Based on Article 4 Resolution 326/2016/UBTVQH14 which regulates the types of Court fees as follows:

(1) Fees for resolving claims related to civil, marriage and family, business, commerce, and labor under the jurisdiction of the Court as stipulated in clauses 1, 2, 3, 4, 6, 7, 8, 9, and 10 of Article 27; clauses 1, 2, 3, 4, 5, 6, 7, 8, 10, and 11 of Article 29; clauses 1 and 6 of Article 31; clauses 1 and 5 of Article 33 of the Civil Procedure Code 2015.

(2) Fees for recognizing and enforcing in Vietnam or not recognizing judgments, decisions of foreign courts, or other competent foreign bodies, or not recognizing said judgments, decisions in Vietnam which do not have enforcement requests or recognizing and enforcing foreign arbitration awards in Vietnam, including:

- Fees for recognizing and enforcing in Vietnam or not recognizing judgments, decisions of foreign courts, or other foreign competent bodies or not recognizing said judgments, decisions in Vietnam without enforcement requests or recognizing and enforcing foreign arbitration awards in Vietnam as regulated in clause 5 of Article 27; clause 9 of Article 29; clauses 4 and 5 of Article 31; clauses 3 and 4 of Article 33 of the Civil Procedure Code 2015;

- Fees for appealing Court's decisions on the recognition and enforcement in Vietnam of foreign court judgments, foreign arbitration awards.

(3) Fees for resolving requests related to Vietnamese commercial arbitration handling disputes under the law on commercial arbitration.

(4) Fees for submitting a request to initiate bankruptcy proceedings.

(5) Fees for considering the legality of strikes.

(6) Fees for arresting sea ships, airplanes.

(7) Fees for executing judicial mandates from foreign courts in Vietnam.

(8) Fees for judicial mandates abroad.

(9) Fees for issuing copies of documents, photocopying materials at the Court, including:

- Fees for photocopying documents, evidence in case files performed by the Court;

- Fees for providing copies of Court judgments, decisions;

- Fees for providing copies of expungement decisions;

- Fees for providing copies of other Court documents.

Thus, currently, there are 9 types of Court fees according to Resolution 326.

What are the court fee rates in Vietnam for 2025?

Based on Section B of the Schedule of court costs and fees issued with Resolution 326/2016/UBTVQH14 which regulates the court fee rates as follows:
