New: Guidance on Determining the Apprenticeship Period for Lawyer Practice

This is one of the important contents mentioned by the Ministry of Justice in Circular 19/2013/TT-BTP guiding the apprenticeship for practicing lawyers.

The internship period for practicing as a lawyer is determined according to Circular 19/2013/TT-BTP as follows:

- The internship period for practicing as a lawyer is twelve months from the date the Executive Board of the Bar Association issues a decision on the registration of the lawyer practice internship;- Persons who are given a reduced internship period for practicing as a lawyer according to Clause 2, Article 16 of the Law on Lawyers will have an internship period of four months;- Persons who are given a reduced internship period for practicing as a lawyer according to Clause 3, Article 16 of the Law on Lawyers will have an internship period of six months.- The internship period for practicing as a lawyer is calculated as the total internship period of that person at lawyer practicing organizations when the intern changes the internship place according to the provisions of Article 7 of Circular 19.- The internship period for practicing as a lawyer is calculated as the total internship period of that person at lawyer practicing organizations when the intern has an internship period at each lawyer practicing organization of at least four months and must have written confirmation from the lawyer practicing organization accepting the intern, and written remarks from the guiding lawyer according to the provisions of Clause 3, Article 13 of Circular 19.

However, an intern at a lawyer practicing organization who has an internship period from one month to less than four months will only have this period counted towards the total internship time if they fall under one of the following cases:

- The lawyer practicing organization accepting the intern temporarily suspends operations or ceases operations according to the provisions of the Law on Lawyers;- The guiding lawyer dies or for health reasons or other objective reasons cannot continue guiding the lawyer practice internship;- The guiding lawyer no longer meets any of the conditions for guiding a lawyer practice internship according to Clause 1, Article 14 of the Law on Lawyers and Article 12 of Circular 19/2013/TT-BTP;- The guiding lawyer does not fully perform the obligations stipulated in Article 13 of Circular 19;- The intern changes the internship place from one centrally-run city or province to another.
