Circular 19: Guidelines for Internship Registration Dossier for Practicing Lawyers

This is an important content addressed by the Ministry of Justice in Circular 19/2013/TT-BTP guiding the apprenticeship practice of lawyering.

According to the provisions of Circular 19/2013/TT-BTP, the registration for apprenticeship is carried out at the Bar Association where the office of the lawyer practice organization accepting the apprentice is located. Specifically, the apprenticeship registration dossier includes:

- Application for registration of legal practice apprenticeship;- Confirmation letter from the lawyer practice organization about accepting the apprentice or an employment contract as stipulated in Clause 1, Article 4 of this Circular;- Copy of the Certificate of graduation from legal practice training or documents proving exemption from legal practice training for cases stipulated in Clause 4, Article 13 of the Law on Lawyers.

Note: In the case that the legal practice apprentice is entitled to a reduction in the apprenticeship period according to the provisions of Clause 2 and Clause 3, Article 16 of the Law on Lawyers, they must attach copies of documents proving eligibility for the reduction in the apprenticeship period.

Procedure for registering legal practice apprenticeship:

- Within five working days from the date of receipt of the complete dossier, the Executive Board of the Bar Association shall issue a decision on the registration of legal practice apprenticeship and register the apprentice's name in the list of apprentices of the Bar Association; in case of refusal, written notification and clear reasons must be provided. The refused applicant has the right to appeal under the provisions of Article 37 of Circular 19/2013/TT-BTP.- Within seven working days from the date of issuance of the decision on registration of legal practice apprenticeship, the Executive Board of the Bar Association is responsible for sending the decision to the lawyer practice organization accepting the apprentice, the Vietnam Bar Federation, and sending a copy to the Department of Justice where the Bar Association is headquartered.- A person whose name is registered in the list of apprentices of the Bar Association is called a legal practice apprentice (hereinafter referred to as apprentice). The apprentice has the rights and obligations as stipulated in Circular 19.
