CIRCULAR
ON PROMULGATING THE LISTS OF MACHINERY, EQUIPMENT, REPLACEMENT PARTS, SPECIAL-PURPOSE VEHICLES, RAW MATERIALS, SUPPLIES AND SEMI-FINISED PRODUCTS MANUFACTURABLE DOMESTICALLY
Pursuant to the Government’s Decree No. 86/2017/ND-CP dated July 25, 2017 defining the functions, tasks, powers and organizational structure of Ministry of Planning and Investment;
Pursuant to the Government’s Decree No. 134/2016/ND-CP dated September 01, 2016 providing guidelines for the Law No. 107/2016/QH13 dated April 06, 2016 on export and import duties;
Pursuant to the Government’s Decree No. 209/2013/ND-CP dated December 18, 2013 on regulating details and providing guidelines for the enforcement of the Law on Value added tax No. 13/2008/QH12; the Government’s Decree No. 100/2016ND-CP dated July 01, 2016 on amendments to the Government’s Decree No. 209/2013/ND-CP dated December 18, 2013 on regulating details and providing guidelines for the enforcement of the Law on Value added tax as amended by the Government’s Decree No. 12/2015/ND-CP dated February 12, 2015;
Pursuant to the Government’s Decree No. 122/2016/ND-CP dated September 01, 2016 specifying schedules of import tariff and preferential import tariff, list of goods and its flat tax, compound tariff, and out-of-quota import tariff;
Pursuant to the Government’s Decree No. 125/2017/ND-CP dated November 16, 2017 on amendments to the Government’s Decree No. 122/2016/ND-CP dated September 01, 2016 specifying schedules of import tariff and preferential import tariff, list of goods and its flat tax, compound tariff, and out-of-quota import tariff;
Pursuant to the Prime Minister’s Decision No. 13/2015/QD-TTg dated 05 May 2015 on mechanisms and policies encouraging the development of public passenger bus service;
Pursuant to the Prime Minister’s Decision No. 08/2017/QD-TTg dated March 31, 2017 guiding the implementation of the Protocol between the Government of the Socialist Republic of Vietnam and the Government of the Russia Federation on supporting the production of motor vehicles in the territory of Vietnam;
Pursuant to the Prime Minister’s Decision No. 09/2017/QD-TTg dated February 31, 2017 guiding the implementation of the Protocol between the Government of the Socialist Republic of Vietnam and the Government of the Republic of Belarus on supporting the production of motor vehicles in the territory of Vietnam;
Minister of Planning and Investment promulgates the Lists of machinery, equipment, replacement parts, special-purpose vehicles, raw materials, supplies and semi-finished products manufacturable domestically:
Article 1. Following lists are enclosed to this Circular:
1. The list of special-purpose vehicles manufacturable domestically (Appendix I);
2. The list of machinery and equipment manufacturable domestically (Appendix II);
3. The list of building materials manufacturable domestically (Appendix III);
4. The list of raw materials, supplies, components and replacement parts manufacturable domestically (Appendix IV);
5. The list of automotive parts and accessories manufacturable domestically (Appendix V);
6. The list of oil and gas production activities' vital materials manufacturable domestically (Appendix VI);
7. The list of ship building raw materials, supplies and semi-finished products manufacturable domestically (Appendix VII);
8. The list of machinery, equipment, raw materials, supplies and components of telecommunications, information technology, digital content and software industries manufacturable domestically (Appendix VIII);
9. The list of plant varieties, animal breeds, fertilizers and plant protection substances manufacturable domestically (Appendix IX).
Article 2. The lists defined in Article 1 of this Circular serve the specification of entities not incurring value added tax according to the Government's Decree No. 209/2013/ND-CP dated December 18, 2013 on regulating details and providing guidelines for the enforcement of the Law on Value added tax and the Government’s Decree No. 100/2016ND-CP dated July 01, 2016 on amendments to the Government’s Decree No. 209/2013/ND-CP dated December 18, 2013 on regulating details and providing guidelines for the enforcement of the Law on Value added tax as amended by the Government’s Decree No. 12/2015/ND-CP dated February 12, 2015; the determination of entities exempted from import tax according to the Government’s Decree No. 134/2016/ND-CP dated September 01, 2016 providing guidelines for the Law on export and import duties; the determination of entities exempted from import tax according to the Prime Minister’s Decision No. 13/2015/QD-TTg dated 05 May 2015 on mechanisms and policies encouraging the development of public passenger bus service, the Prime Minister’s Decision No. 08/2017/QD-TTg dated March 31, 2017 guiding the implementation of the Protocol between the Government of the Socialist Republic of Vietnam and the Government of the Russia Federation on supporting the production of motor vehicles in the territory of Vietnam and the Prime Minister’s Decision No. 09/2017/QD-TTg dated February 31, 2017 guiding the implementation of the Protocol between the Government of the Socialist Republic of Vietnam and the Government of the Republic of Belarus on supporting the production of motor vehicles in the territory of Vietnam.
Article 3. Domestically manufacturable goods as stated in the Lists enclosed to this Circular are universal regardless of purposes of use, except special-use goods.
Special-use goods as stipulated in this Article refer to those, when used, mandatorily fulfilling specific technical standards that are stated in certificates for specific sectors.
Article 4. This Circular takes effect as of May 15, 2018 and supersedes the Circular No. 14/2015/TT-BKHDT dated November 17, 2015 by Ministry of Planning and Investment on promulgating the Lists of machinery, equipment, replacement parts, special-purpose vehicles, raw materials, materials, components and semi-finished products manufacturable domestically.
During the enforcement of this document, inquiries should be promptly related to Ministry of Planning and Investment for research and amendments.
