Regarding this issue, LawNet would like to answer as follows:

1. Working time and annual leave of preschool teachers in Vietnam

Working time and annual leave of preschool teachers according to Article 3 of Circular 48/2011/TT-BGDDT are as follows:

- The working time of a preschool teacher in a year is 42 weeks, of which:

+ 35 weeks of work raising, caring for, and educating children (hereinafter referred to as teaching children);

+ 04 weeks for study and professional training;

+ 02 weeks for preparing for the new school year;

+ 01 week for summarizing the school year.

- The annual leave period of preschool teachers includes: summer vacation and other holidays, specifically as follows:

+ Teachers' summer vacation period is 8 weeks, with full salary and allowances (if any);

+ Other days off comply with the provisions of the Labor Code and current regulations.

Based on the school year plan, scale, characteristics, and specific conditions of each school, the principal arranges annual leave time for teachers in a reasonable manner according to regulations.

2. Teaching hours for preschool teachers in Vietnam

Teaching hours of preschool teachers according to Article 4 of Circular 48/2011/TT-BGDDT are as follows:

- For teachers teaching groups of children, kindergarten classes have 2 sessions/day, each teacher teaches in the classroom for 6 hours/day and performs preparation work for classroom teaching as well as other tasks prescribed by the Principal to convert to guaranteed work of 40 hours/week.

- For teachers teaching groups of children, kindergarten classes study 1 session per day. Each teacher teaches in the classroom for 4 hours/day and performs preparation work for classroom teaching as well as other work assigned by the teacher. The principal stipulates to convert to ensure 40 hours/week of work.

- For teachers teaching classes with children with disabilities learning inclusively, each teacher teaches the full number of hours as prescribed in Clause 1 or Clause 2, Article 4 of Circular 48/2011/TT-BGDDT; in which, for every 01 disabled child/class, each teacher is charged an additional 0.5 hours of teaching/day.

- For principals and vice principals, in addition to performing the duties of principals and vice principals as prescribed in the kindergarten charter, the principal must directly participate in educational activities (teaching children or observing teachers' teaching hours in the school) for two hours a week; the vice principal must directly participate in educational activities for four hours a week.

3. Instructions on grading salaries for preschool teachers in Vietnam

Salary grading for preschool teachers according to Article 8 of Circular 01/2021/TT-BGDDT are as follows:

- Officials appointed to the professional positions of preschool teachers specified in Circular 01/2021/TT-BGDDT shall apply the corresponding salary schedule issued with Decree 204/2004/ND-CP on salary regime for cadres, civil servants, public employees, and armed forces, specifically as follows:

+ Grade III preschool teachers, code V.07.02.26, are eligible for the salary coefficient of type A0 public employees, from salary coefficient 2.10 to salary coefficient 4.89;

+ Grade II preschool teachers, code V.07.02.25, are eligible for the salary coefficient of type A1 public employees, from salary coefficient 2.34 to salary coefficient 4.98;

+ Grade I Kindergarten teacher, code V.07.02.24, is subject to the salary coefficient of type A2 public employees, group A2.2, from salary coefficient 4.0 to salary coefficient 6.38.

- Salary grading upon appointment to a professional title class shall comply with the instructions in Clause 1 of Section II of Circular 02/2007/TT-BNV guiding salary rankings when upgrading, transferring ranks, changing categories of civil servants and public employees, and according to current provisions of law.

When implementing the new salary policy, the transfer to the new salary will be carried out according to the Government's regulations.
