Regarding this issue, LawNet would like to answer as follows:

1. Position and functions of the General Department of Customs in Vietnam

The General Department of Customs is an organization directly under the Ministry of Finance, performing the function of advising and assisting the Minister of Finance in state management of customs and organizing customs law enforcement nationwide.

The General Department of Customs has legal status, a seal with the national emblem, a separate account at the State Treasury, and headquarters in Hanoi.

2. Who is the spokesman and information provider for the press of the General Department of Customs in Vietnam?

According to Article 2 of the Regulations issued together with Decision 178/QD-TCHQ in 2019, the spokesman and providing information to the press of the General Department of Customs are as follows:

(1) The person who makes the statement and provides information to the press of the General Department of Customs (hereinafter referred to as the Spokesperson) includes:

(i) Director of the General Department of Customs;

(ii) A Deputy Director General is assigned by the Director General to speak and provide information to the press regularly;

Full name, position, phone number, and email address of the spokesperson shall be published in writing to the state management agency in charge of the press and posted on the portal of the General Department of Customs (www.customs.gov.vn), within 12 hours since the General Director signed the document assigning tasks.

(iii) Persons authorized to speak include: Deputy General Directors of the General Department of Customs, heads of units under and under the General Department of Customs or persons assigned to coordinate with the Spokesperson to make statements. or provide information to the press on relevant issues in each specific case.

(2) The spokesperson specified in (ii) of (1) if unable to speak and provide information to the press, must report to the Director of the General Department of Customs to authorize the responsible person of the General Department of Customs as prescribed in (iii) of (1) to be responsible for speaking and providing information to the press.

(3) The person who makes statements and provides information to the press ((iii) of (1)) is responsible to the Director General for the content of the statement and providing information to the press.

(4) The authorization to speak specified in (iii) of (1) is made in writing, applies only in each case, and has a certain time limit.

When performing authorization, the full name, position, phone number, and e-mail address of the person authorized to speak, the authorization document must be posted on the Customs Portal/Website within 12 hours from the date of signing the authorization document.

(5) The person authorized to speak as specified in (iii) of (1) may not further authorize another person.

(6) Customs officers, employees, and employees who are not assigned the task of speaking and providing information to the press, are allowed to provide information to the press in accordance with the law. but not on behalf of the Customs to speak, provide information to the press, and take responsibility before the law for the content of the information provided.

3. Forms of announcement and information provision for the press by the General Department of Customs in Vietnam

The announcement and provision of information to the press by the General Department of Customs shall be carried out in the following forms:

- Organizing press conference.

- Posting statements and providing information on Customs Portal/Website and Customs Newspaper.

- Directly speaking to or giving interviews to journalists and reporters.

- Sending press releases, press information, and responses to press agencies, journalists, and reporters in writing or by email.

- Providing information through direct exchange or at briefings held by the central and local press when requested.

- In case the press agencies publish or broadcast inaccurate information content, the spokespersons and authorized speakers have the right to issue a written request to the press agency to publish, issue feedback, correct, or apologize for the information content in the press.
