Who is the legal representative of the Farmers Support Fund in Vietnam?

Pursuant to Article 12 of Decree 37/2023/ND-CP (effective from August 8, 2023), the director is the legal representative of the Farmers Support Fund, responsible to the Management Board, the Standing Board of the Farmers' Association at the same level and to the law for all activities of the Farmers Support Fund.

Criteria and conditions for the appointment and re-appointment of the Director of the Farmers Support Fund:

- Being a Vietnamese citizen, permanently residing in Vietnam, having full civil act capacity;

- Having a university degree or higher in one of the following majors: Economics, finance, banking, agriculture and rural development, business administration, law, accounting, or auditing;

- Having at least 05 years' working experience at the Farmers Support Fund for the Central/provincial Farmers Support Fund and 03 years for the District Farmers' Support Fund;

- Other standards and conditions at the request of management of the Farmers' Association at the same level as stipulated in the Charter on the organization and operation of the Farmers Support Fund.

The Director of the Farmers Support Fund has the following duties and powers:

- Organizing and managing the operation of the Farmers Support Fund according to the provisions of this Decree, the organization and operation charter of the Farmers Support Fund, and the decisions of the Management Council, the Standing Board of the Farmers' Association at the same level;

- Submitting to the Management Council for promulgation regulations on the professional activities of the Farmers Support Fund according to its competence;

- Directly managing assets and operating capital and taking responsibility for their decisions before the Standing Board of the Farmers' Union at the same level and the Management Council according to the provisions of law and the Charter of the organization and operation of the Farmers Support Fund;

- Approving loans, deciding on capital mobilization plans, and dealing with risks within their competence;

- Deciding to recruit personnel in the form of labor contracts to perform the tasks of the Farmer Support Fund;

- Performing other powers and duties at the request of the Management Board and in the Charter on organization and operation of the Farmers Support Fund.

Regulations for Deputy Director and Chief Accountant of Farmers Support Fund in Vietnam

(1) Deputy Director of Farmers Support Fund:

- The Deputy Director is responsible for assisting the Director in managing the activities of the Farmers Support Fund as assigned and authorized; taking responsibility before the Director, the Management Council, and the Standing Board of the Farmers' Association at the same level and before the law for the assigned and authorized tasks;

- Criteria, conditions, appointment authority, term, and number of Deputy Directors are specified in the Charter on the organization and operation of the Farmers Support Fund.

(2) Chief Accountant of Farmers Support Fund

- The Chief Accountant is responsible for organizing the accounting work of the Farmer Support Fund, assisting the Management Board and the Director in financial supervision at the Fund according to the provisions of the law on finance and accounting; taking responsibility before the Board of Management, the Director for the performance of assigned or authorized tasks and powers, and performing other functions and duties as prescribed in the Law on Accounting and current regulations of relevant laws;

- The chief accountant of the Farmer Support Fund must meet the criteria and conditions prescribed in the Law on Accounting, guiding documents, amendments, supplements, and replacements (if any). Criteria, specific conditions, and authority to appoint the Chief Accountant are specified in the Charter on the organization and operation of the Farmers Support Fund.
