1. What are the ranks of non-commissioned officers and enlisted soldiers in Vietnam?

According to Article 4 of Circular 07/2016/TT-BQP, the military ranks of non-commissioned officers and enlisted soldiers include:

- Non-commissioned officers of the Vietnam People's Army have three ranks: Sergeant, Sergeant, and Corporal.

- Soldiers of the Vietnam People's Army have two ranks: First Class and Private.

2. Who has the authority to confer, promote, or demote the military rank of non-commissioned officers and enlisted soldiers in Vietnam?

Specifically, according to Article 5 of Circular 07/2016/TT-BQP, the competence to confer, promote, and demote the military ranks of non-commissioned officers and enlisted soldiers is as follows:

(1) Consecration to the rank of Private

- Regiment commanders, brigade commanders, and equivalent positions decide to confer the rank of Private to the soldiers under their authority;

- Commanders of Military Commands of districts, towns, provincial cities, and equivalent administrative units (hereinafter referred to as district-level military commanders) shall decide to confer the military rank of Private on citizens registered to serve in the reserve rank of the People's Army who have been arranged and appointed to the reserve mobilization unit.

(2) Promoting and demote the military ranks of non-commissioned officers and active-duty soldiers.

- Battalion commanders and equivalent positions decide to promote soldiers to the rank of First Class under their authority;

- Regiment commander, brigade commander, and equivalent positions decide to promote or demote the rank to Sergeant for non-commissioned officers and enlisted soldiers under their authority;

- Divisional commanders and equivalent positions decide to promote and demote the military rank of Sergeant Major for non-commissioned officers and enlisted soldiers under their command.

(3) In the event that non-commissioned officers and enlisted soldiers violate discipline and are no longer eligible for military service, they shall have their military titles stripped in accordance with the provisions of the Ordinance on Management of the Vietnamese People's Army.

(4) Promoting and demoting military ranks for non-commissioned officers and reserve soldiers

- The commander of the district-level Military Command decides to promote and demote the military rank to Sergeant for non-commissioned officers, soldiers registered to serve in the reserve ranks of the Vietnam People's Army who have been arranged and appointed to the reserve mobilization unit.

- Commanders of Military Commands of Provinces and Centrally Run Cities, High Command of Hanoi Capital, and High Command of Ho Chi Minh City (hereinafter collectively referred to as Commanders of Provincial Military Commands) ) decide to promote or demote the rank of Sergeant Major for non-commissioned officers and enlisted soldiers registered to serve in the reserve ranks of the Vietnam People's Army who have been arranged and appointed to the reserve mobilization unit.

3. Rights and obligations of non-commissioned officers and enlisted soldiers in Vietnam

Non-commissioned officers and enlisted soldiers have the following rights and obligations:

- The State shall ensure the preferential policies for non-commissioned officers and enlisted soldiers according to the characteristics of People’s Army.

- Obligations of non-commissioned officers and enlisted members:

+ Be strictly loyal to the motherland, people, the Communist Party and the State of the Socialist Republic of Vietnam;

+ Always ready to fight and sacrifice their lives for the independence, sovereignty, unity and territorial integrity of Vietnam; protect People, Communist Party, the State and socialist regime; complete all assigned tasks and perform international duties;

+ Protect properties and benefits of the State, agencies, organizations; protect lives, properties and lawful rights and interests of People; participate in protection of national security and social order and safety according to the provisions of laws;

+ Strictly comply with the lines and policies of Communist Party, policies and laws of the State, regulations and instructions of People’s Army;

+ Participate in training in politics, military, culture, science, technique, specialist skills; improve the organization, discipline and physical fitness; increase political stuff, fighting skill and spirit.
