Regarding this issue, LawNet would like to answer as follows:

1. Which cases of preschool teachers must improve their training standards?

According to Clause 1, Article 2 of Decree 71/2020/ND-CP, pre-school teachers who do not have a pedagogical college diploma or higher, have 07 years of work (84 months) from July 1, 2020, until the prescribed retirement age.

2. Implementation roadmap to raise the standard level of training for preschool teachers in Vietnam

Specifically, in Article 4 of Decree 71/2020/ND-CP, the roadmap for raising the standard qualifications of preschool teachers is as follows:

- The roadmap will be implemented from July 1, 2020, to the end of December 31, 2030.

The route is implemented in two phases:

+ Phase 1: From July 1, 2020, to the end of December 31, 2025, ensure that at least 60% of the preschool teachers who are being trained or have completed the training program are granted a pedagogical college diploma;

+ Phase 2: From January 1, 2026, to the end of December 31, 2030, implemented for the remaining teachers to ensure that 100% of preschool teachers who complete the training program will be awarded a pedagogical college diploma.

3. Rights and responsibilities of preschool teachers participating in training to raise standards

Pursuant to Article 10 of Decree 71/2020/ND-CP, the rights and responsibilities of teachers participating in training to raise the standard are as follows:

- Right of teachers sent to training to raise standards:

+ Being facilitated by the management and using agency in terms of time; being supported with tuition fees (applicable in accordance with current regulations of the law for pedagogical students);

+ The training time is counted into the continuous working time;

+ Enjoying 100% of salary and other regimes and allowances as prescribed by law.

- Responsibilities of teachers sent to train to raise standards:

+ Implementing regulations on training and regulations on training time; be under the management of the training institution while participating in training activities;

+ Having a commitment to perform tasks and official duties at the preschool or general education institution after completing the training program for at least 02 times the training duration;

+ During the duration of the course, the teacher still has to perform the prescribed work duties when not participating in training activities;

+ In case a teacher fails to complete the training program within the prescribed time, leading to an extension of the training period, the training expenses incurred during the extended training period must be self-sufficient.

4. Cases where preschool teachers have to compensate for training costs

Pursuant to Article 11 of Decree 71/2020/ND-CP, compensation for training costs is as follows:

- Teachers who are sent for training to raise their standards must compensate for training expenses in one of the following cases:

+ Voluntarily quitting school, quitting, or unilaterally terminating the work contract or labor contract during the training period;

+ Not being granted a diploma by a training institution, unless there is an objective reason for force majeure certified by a competent authority;

+ Having completed and been granted a diploma of the course but quit or unilaterally terminate the working contract or labor contract when not serving the full commitment period specified at Point b, Clause 2, Article 10 of Decree 71 2020/ND-CP.

- Compensation costs, methods of calculating compensation costs, and orders and procedures for compensation for training expenses shall comply with current regulations of law applicable to cadres, civil servants, and public employees.
