The Ministry of Home Affairs of Vietnam issued Circular 06/2023/TT-BNV on the regulations on updating, using, and exploiting data and information from the National Database on cadres, civil servants, and public employees in state agencies (Regulations).

1. Where is the data of cadres, civil servants, public employees, and employees stored?

According to Article 10 of the Regulation promulgated together with Circular 06/2023/TT-BNV, the storage of cadres, civil servants, public employees, and employees is regulated as follows:

- Data of cadres, civil servants, public employees, and employees is stored in the National Database and databases of ministries, branches, and localities according to management decentralization and is backed up periodically every month, at least three months, on a dedicated storage medium for risk prevention.

- The storage and backup must comply with the party's regulations, the law on storage, the protection of state secrets and ciphers, privacy protection of personal information, and information safety and security.

Thus, the data of cadres, civil servants, public employees, and employees is stored in the national database and the databases of ministries, branches, and localities according to management decentralization.

2. Instruction on use of data by cadres, civil servants, public employees, and employees in Vietnam

The exploitation of data of officials, civil servants, public employees, and employees is regulated as follows:

- The Ministry of Home Affairs uses data from the National Database to synthesize and analyze the contingent of cadres, civil servants, public employees, employees, organizational structure, payroll, employment positions, and other contents in the field of state management of the Ministry of Home Affairs, serving the leadership, direction, and administration of the Government and the Prime Minister;

Connecting and sharing data from the National Database with other information systems serving state agencies and officials, civil servants, public employees, and employees to exploit information in accordance with the Regulations promulgated together with Circular 06/2023/TT-BNV.

- Ministries, branches, and localities are entitled to exploit and use general data, general analysis, and data on cadres, civil servants, public employees, and employees of their ministries, branches, and localities in the National Database;

These data are shared by default from the National Database on the databases of their ministries, branches, and localities to serve the direction and administration of functions and tasks.

- Cadres, civil servants, public employees, and employees may exploit their data; they may access, research, use, and exploit data on national databases, databases of ministries, branches, and localities. When competent agencies manage cadres, civil servants, and public employees, the employee agrees in writing as prescribed by law.

- Data of cadres, civil servants, public employees, and employees of the national database, databases of ministries, branches, and localities, when exported in electronic document format, digitally signed by a competent person, and digitally signed by a state agency in accordance with law, has the same legal validity as the original paper document.

3. Methods of exploiting and using the data of cadres, civil servants, public employees, and employees in Vietnam

Pursuant to Article 9 of the Regulation promulgated together with Circular 06/2023/TT-BNV, ministries, branches, and localities shall exploit and use the data of the National Database by:

- The account is provided by the Ministry of Home Affairs and accessed through the Portal of the National Database on cadres, civil servants and public employees in state agencies at https://ccvc-portal.moha.gov.vn (using a dedicated data transmission network of Party and State Agencies).

- Use data sharing services on the basis of ensuring information security and protecting personal data.
