What you should know about regulation regarding having from 3 children as a Party member in Vietnam

According to Article 27 of Vietnam's Regulation 102-QD/TW stipulates the disciplinary measures for party members who give birth to 3, 4, and 5th children as follows:

- Reprimand in the case of a third child's birth (unless otherwise provided by law).

- Warning or dismissal (if there is a position) in the case of giving birth to a fourth child (unless otherwise provided for by law).

-Exclusion in case of giving birth to the fifth child or more; cheating in giving birth or adopting a child that is actually a biological child in order to intentionally give birth to another child outside the regulations.

Currently, the law also stipulates some cases where party members are not considered to have violated population policy.

According to Vietnam's Instruction 04-HD/UBKTTW dated March 22, 2018, stipulating cases where party members are not considered violations of population and family planning policies, including:

The couple has a third child if both or one of them belongs to an ethnic group with a population of less than 10,000 people or an ethnic group at risk of population decline (birth rate is less than or equal to the death rate).

According to the official announcement of the Ministry of Planning and Investment of Vietnam,

- A couple giving birth for the first time but having three or more children.

- The couple has had one biological child, giving birth for the second time but giving birth to two or more children.

- The couple gives birth for the third time or more, if at the time of birth there is only one biological child alive, including the biological child already adopted.

- The couple gives birth for the third time, if they already have two biological children but one or both of them is malformed or has a fatal non-hereditary disease, which has been approved by the provincial or central medical assessment council.

Couples who have had their own children (natural children): give birth to one child or two children, if one of them already has a stepchild (natural child); give birth to one or two or more children in the same birth, if both of them already have their own children (natural children).

Note: This provision does not apply to cases where two people have had two or more children in common and the children are currently alive.

In addition, in the case of giving birth to a third child due to an unwanted pregnancy, if family planning measures are taken that seriously affect the mother's health (certified by a district-level hospital or equivalent to up), they will not consider and take disciplinary action.

Therefore, cases of giving birth to the third child or more will be disciplined: reprimand, warning or dismissal, expulsion. However, if you are in cases that are not considered violations of the above-mentioned population and family planning policies, you will not be disciplined.
