1. What Ministry does the Department of Land belongs to?

The Department of Land is an organization directly under the Ministry of Natural Resources and Environment, with the function of advising and assisting the Minister in formulating and guiding the implementation of policies and laws on land; rights and obligations of land users; assessing the impact of policies and laws on land; monitor and evaluate the management and use of land; inspect the implementation of policies and laws on land.

(Article 1 of Decision 2966/QD-BTNMT)

2. Duties and powers of the Department of Land of Vietnam

Duties and powers of the Department of Land in Vietnam include:

(1) Development of policies and laws on land:

- Synthesizing and proposing a program to develop long-term and annual legal documents on land;

- Assuming the prime responsibility for, and coordinating with relevant units in, formulating land policies; making proposals and organizing the formulation of laws and resolutions of the National Assembly; ordinances and resolutions of the National Assembly Standing Committee; decrees and resolutions of the Government; decisions and directives of the Prime Minister and other documents on land as assigned by the Minister;

- Participating in the development of legal documents related to the land sector as assigned by the Minister;

- Participating in giving opinions and coordinating in appraising policies and laws related to land;

- Assessing the impact of policies and laws on land;

- Proposing solutions to solve the overlapping of land law and other relevant specialized laws.

(2) Review, systematization and consolidation of legal documents on land and codification of the legal system on land; examine and handle legal documents on land:

- Proposing a plan to review and systematize legal documents on land; organizing the implementation after it is approved;

- Assuming the prime responsibility for, and coordinating with relevant units in, formulating consolidation documents on land as assigned by the Minister;

- Assuming the prime responsibility for, and coordinating with relevant units in, formulating a Code of Legal Regulations on the legal system of land under the Ministry's state management;

- Taking charge and cooperating in examining and recommending to competent agencies how to handle legal documents on land.

(3) Guiding the exercise of the rights and responsibilities of the state; rights and obligations of land users according to the regime of using different types of land and when exercising their land use rights.

(4) Organizing the propagation, dissemination, and education of policies and laws on land as assigned by the Minister.

(5) Inspection of the implementation of land policies and laws:

- Proposing a plan to inspect the implementation of land policies and laws and organize the implementation after being approved;

- Receiving, synthesizing, evaluating, and process information on the implementation of land policies and laws provided by agencies, organizations, and individuals;

- Guiding the implementation of land policies and laws nationwide in accordance with law;

- Assuming the prime responsibility for, and coordinating with relevant units in, guiding and inspecting the implementation of law provisions on land management and use by People's Committees at all levels and land users.

(6) Organizing the construction, management, and operation of a monitoring and evaluation system for land management and use; guiding and inspecting the management and operation of the monitoring and evaluation system for land management and use in the locality.

(7) Carrying out legal support activities for people and businesses in the field of land as assigned by the Minister.

(8) Giving legal opinions on the handling of issues in the field of land as assigned by the Minister.

(9) Regarding international law and the implementation of land law policies with foreign elements:

- Participating, giving legal and institutional opinions in negotiation, signing, ratification, approval, accession, reservation, effect, amendment, supplement, extension, and organizing the implementation of international treaties in the field of land management as assigned by the Minister;

- Proposing the content of legalizing the provisions of international treaties on land management in the development of legal documents;

- Taking the lead in guiding and inspecting the exercise of the right to access land, the rights and obligations of land users towards foreign organizations and individuals, and foreign-invested economic organizations as assigned by the Minister.

(10) Advising and answering the opinions, recommendations, and questions of the National Assembly deputies about the land field as assigned by the Minister.

(11) Coordinating with units under the Ministry to answer organizations and individuals about land policies and laws as assigned by the Minister.

(12) Participating in scientific research, international cooperation programs, and projects as assigned by the Minister.

(13) Carrying out administrative reform according to the PAR programs and plans of the Ministry and as assigned by the Minister; practicing thrift; preventing and fighting corruption and waste according to the provisions of law.

(14) The focal point for summarizing and reporting on land management; make statistics and report periodically and irregularly on the performance of assigned tasks.

(15) Managing civil servants and assets under the Department according to regulations.

(16) Performing other duties assigned by the Minister.
