1. What is Vietnam National Centre for Criminal Record?

According to Article 1 of Decision 97/QD-BTP of 2011, Vietnam National Centre for Criminal Record (hereinafter referred to as the Center) is a public service unit under the Ministry of Justice, with the function of building and managing the judicial records database nationwide.

Vietnam National Centre for Criminal Record has legal status, is headquartered in Hanoi city, has its own seal and account at the State Treasury according to the provisions of law.

2. Duties and powers of Vietnam National Centre for Criminal Record

Vietnam National Centre for Criminal Record has the following tasks and powers according to Article 2 of Decision 97/QD-BTP of 2011:

- Regarding building and managing the judicial record database

+ Build, manage, exploit and protect the judicial records database nationwide;

+ Guidance on building, managing, exploiting and protecting the judicial record database at the Department of Justice of provinces and centrally run cities (hereinafter referred to as the Department of Justice);

+ Receive, update and process judicial record information provided by the Supreme People's Procuracy, competent agencies under the Ministry of Public Security, judgment enforcement agencies under the Ministry of National Defense and the Department of Justice;

+ Receive criminal records provided by the Department of Justice;

+ Provide criminal background information to the Department of Justice;

+ Prepare judicial records; issue judicial record cards according to authority;

+ Provide criminal background information of foreigners convicted by Vietnamese Courts at the request of the Supreme People's Procuracy;

- Perform a number of tasks in the field of judicial records assigned by the Minister, including:

+ Develop and submit to the Minister strategies, planning, plans, medium- and long-term policies on judicial records; Develop schemes, projects, and draft legal documents on judicial records for the Minister to promulgate or submit to competent authorities for promulgation; Participate in evaluating and commenting on other projects and draft documents assigned by the Minister;

+ Develop and submit to the Minister the Center's long-term, 5-year, and annual work plans; Participate in building strategies, planning, and long-term, 5-year, and annual development plans for the justice sector;

+ Develop and submit to the Minister for promulgation, guidance, and inspection of the use of forms, papers, and books on judicial records;

+ Organize and implement strategies, planning, plans, guidelines, policies, schemes, and projects; Legal documents within the scope of the Center's functions and professional guidance on judicial records;

+ Carry out propaganda and dissemination of laws on judicial records; Training and professional development on judicial records according to the assignment and decentralization of the Ministry;

+ Deploy the application of information technology in building databases and managing judicial records according to the provisions of law and decentralization of the Ministry;

+ Carry out international cooperation on judicial records according to the provisions of the law and decentralization of the Ministry;

+ Implement the statistical and reporting regime on judicial records and manage the judicial record database according to the provisions of law.

- Carry out inspections and participate in inspections of the implementation of legal regulations on judicial records; Resolve complaints and denunciations according to the provisions of the law and the decentralization of the Ministry;

- Implement financial and accounting regimes and manage and use the Center's budget and assets according to the provisions of law and decentralization of the Ministry;

- Carry out emulation, reward, and management of the Center's team of civil servants, public employees, and workers according to the provisions of the law and decentralization of the Ministry;

- Perform other tasks assigned by the Minister.
