Regarding this issue, LawNet would like to answer as follows:

1. What is tourist transport business?

According to Clause 1, Article 45 of the Law on Tourism 2017, tourist transport business is the provision of air, sea, water, railway and land transport services for tourists according to tour programs and at tourism areas and tourist attractions.

2. Regulations on means of tourist transport in Vietnam

Regulations on means of tourist transport according to Articles 6 and 7 of Circular 42/2017/TT-BGTVT are as follows:

2.1. Regulations on means of tourist transport by road in Vietnam

Regulations for means of tourist transport by road are as follows:

- Automobiles must ensure quality, technical safety, and environmental protection as prescribed by law.

- Automobiles must be equipped with cruise monitoring devices, according to regulations.

- Automobiles must be posted with all the information prescribed; next to the bed, there must be a board instructing passengers on traffic safety and emergency exits in the event of an incident, as prescribed by the Minister of Transport.

Passenger automobiles must have the following interior and amenities:

+ Automobiles with less than 9 seats must have equipment including: air conditioner, beverage container, first aid medical equipment, backup medicine bag, escape tool, and the name and phone number of the driver. vehicle owner at the position behind the driver's seat;

+ Automobiles from 09 seats to less than 24 seats, in addition to the regulations for Automobiles with less than 09 seats, must also be equipped with: sunscreen curtains, safety instructions, trash cans;

+ Automobiles with 24 seats or more (except for specialized caravan Automobiles), in addition to the regulations for Automobiles from 09 seats to less than 24 seats, must also be equipped with additional microphones and luggage storage for tourists. There are positions for the elderly and disabled according to regulations.

2.2. Regulations on means of tourist transport by inland waterways

Regulations for means of tourist transport by inland waterways are as follows:

- Vehicles must ensure technical safety and environmental protection according to regulations.

- Vehicles must install an Automatic Identification System (AIS) when operating on the route from shore to island or between islands, as prescribed by law.

- Being equiped with enough life jackets for tourists on board.

- Inland waterway means of transporting tourists must ensure the following furniture and amenities:

+ For vehicles from 12 seats to 20 seats, they must be equipped with:

++ Instructions on the use of life-saving and life-saving equipment and phone numbers and addresses of search and rescue agencies are placed at the passenger's seat;

++ Itinerary chart of the tourist route;

++ There are containers for drinks and the recycle bin.

+ For vehicles from 20 seats to 50 seats, in addition to the regulations for vehicles from 12 seats to 20 seats, they must also be equipped with:

++ UV protection equipment, microphone; medicine cabinet, and first aid and rescue equipment according to the list prescribed by the Ministry of Health;

++ Food service area and processing area (if any) must meet the requirements according to the regulations of the Ministry of Health and ensure the safety regulations on fire and explosion prevention.

+ For vehicles with more than 50 seats, in addition to the regulations for vehicles from 20 to 50 seats, they must be equipped with:

++ Awnings, curtains against the sun, air conditioning, or cooling fans corresponding to the number of tourists transported;

++ Restroom.

- For cruise ships staying in tourism, comply with the Government's regulations.
