What is the difference between Lawyers and members of Vietnam Lawyers Association?

Attorney and Lawyers in Vietnam can be distinguished by some basic criteria as follows:

* Text correction:

- Attorney: Law on Lawyers and legal documents guiding the Law on Lawyers.

- Lawyers: The Charter of Vietnam Bar Association is promulgated together with Decision 770/QD-TTg.

* Standard:

- Attorney means a person who fully meets the standards and conditions for practice as prescribed by the Law on Lawyers and provides legal services at the request of individuals, agencies or organizations.

- Lawyers: Vietnamese citizen with civil act capacity, good moral character, bachelor's degree in law or higher, or bachelor's degree in other majors but has been doing legal work for at least three years and above, agreeing to the Association's Charter can join the Vietnam Bar Association.

* Participating organizations:

- Attorney: Socio-professional organizations of lawyers are Bar Associations in provinces and centrally run cities and Vietnam Bar Federation.

- Lawyers: The Vietnam Lawyers Association is a political-social-professional organization, unified and voluntary of jurists throughout the country, a member of the Vietnam Fatherland Front, under the leadership of Mr. Communist Party of Vietnam, the management of the State of the Socialist Republic of Vietnam.

* The right to participate in legal proceedings, provide legal services and provide legal advice:

- Attorney:

+ To participate in legal proceedings, provide legal services and provide legal advice to clients as a lawyer.

+ To agree on remuneration with the client for the provision of legal services (except for criminal cases where the remuneration must be complied with as prescribed by law).

- Lawyers:

+ Only participate in legal proceedings, provide legal services, and provide legal advice as assigned by the Legal Aid Center or the Legal Counseling Center;

+ Not to perform legal services with remuneration as an individual.
