What are the regulations on the content of civil servant assessment in Vietnam? - My Duyen (Nghe An)
Pursuant to Article 56 of the Law on Cadres and Civil Servant 2008, as amended by Clause 11 Article 1 of the Law amending Law on Cadres and Civil Servants and the Law on Public Employees 2019, civil servants are evaluated according to the following contents:
- Abiding by the lines, guidelines, and policies of the Party and the laws of the State, regulations of agencies, organizations and units;
- Political qualities, ethics, lifestyle, working style, and manners;
- Competency, professional qualifications, and expertise;
- Results of performing tasks according to the provisions of law, according to the set plan, or according to specific assigned tasks; progress and quality of task performance. The assessment of task performance must be associated with the job position and expressed through specific work and products;
- Sense of responsibility and coordination in performing tasks;
- Attitude to serve people and businesses for positions in direct contact or directly dealing with people and businesses.
In addition to the above contents, civil servants holding leadership and management positions are also evaluated according to the following contents:
- Working plan and operation results of agencies, organizations, and units assigned to lead and manage; the evaluation of the individual's performance of tasks must be associated with the results of the task performance of the agency, organization, or unit directly in charge. The individual's quality rating is not higher than the quality rating of the agency, organization, or unit directly in charge;
- Progress and quality of the assigned work;
- Leadership and management capacity;
- The ability to gather and unite.
The evaluation of civil servants is carried out as follows:
- Annual assessment; evaluate before conducting consideration for rank increase, salary increase ahead of time, appointment, re-appointment, planning, and mobilization; assessment before the end of rotation, secondment;
- Based on the management requirements of agencies, organizations, or units, heads of agencies competent to manage civil servants shall prescribe evaluations of civil servants on a quarterly, monthly, or weekly basis that are suitable to the specific work of their agencies, organizations, and units, ensuring publicity, democracy, objectivity, and quantification by specific results and products; assessment results are the basis for performing the assessment of civil servants specified at Point a of this Clause.
Pursuant to the above provisions, heads of agencies, organizations, and units employing civil servants shall issue regulations on the assessment of civil servants in their agencies, organizations, or units.

(1) For civil servants who are heads of agencies, organizations, or units:
- Civil servants self-evaluate and grade quality
Civil servants make self-assessment reports and receive the rating of work results according to their assigned responsibilities and tasks according to Form No. 02 of the Appendix issued together with this Decree.
- Comments and evaluations of civil servants:
Holding a meeting at the agency, organization, or unit where the civil servant works to comment on and evaluate the civil servant.
Participants in the meeting include all civil servants of agencies, organizations, and units.
In cases where an agency, organization, or unit has a constituent unit, the composition includes the collective leadership of the agency, organization, or unit, representatives of the Party committee, trade union, and youth union at the same level, and heads of constituent units; For large-scale agencies, organizations, and units, the heads of the constituent units may give their opinions in writing.
The civil servant presents the report on self-assessment of the work results at the meeting, and the members attending the meeting give comments. The opinions must be recorded in the minutes and approved at the meeting.
- Collect comments and assessments from the party committees of agencies, organizations, and units where the civil servants work.
- Reviewing, deciding to evaluate, and classifying the quality of civil servants
The advisory body on personnel work of the agency competent to evaluate shall synthesize comments and evaluations specified at Points b and c of this Clause and related documents (if any), propose evaluation contents and quality ratings for civil servants.
Competent authorities decide to evaluate and classify the quality of civil servants.
- The level competent to evaluate civil servants shall notify the civil servants in writing and publicly announce the results of the evaluation and quality rating; decide on the form of publicity in the agency, organization, or unit where the civil servant works, with priority given to the application of the form of publicity in the electronic environment.
(2) For deputies of the head and civil servants under the management of the head:
- Civil servants self-evaluate and grade quality.

In cases where a civil servant is a deputy of the head of an agency, organization, or unit with a constituent unit, the composition includes the collective leadership of the agency, organization, or unit, representatives of the party committee or trade union, youth unions of the same level, and heads of constituent units; For large-scale agencies, organizations, and units, the heads of the constituent units may give their opinions in writing.

For civil servants who are deputies of the heads, heads of agencies, organizations, or units shall base themselves on comments and assessments specified at Points b and c of this Clause and relevant documents (if any) to decide the evaluation content and quality rating for civil servants.
For civil servants under the management of the head, the head of the agency, organization, or unit shall, based on the opinions at the meeting to review and evaluate the above provisions, decide on the evaluation content.
