Regarding this issue, LawNet would like to answer as follows:

1. What is FTAP?

According to Clause 2, Article 2 of the Regulations issued together with Decision 2371/QD-BCT in 2022, the Electronic Information Portal on Vietnam Free Trade Agreement (hereinafter referred to as FTAP) at https://fta.gov.vn is the Government-level electronic information portal about all FTAs that Vietnam is participating in.

2. Functions and tasks of FTAP in Vietnam

The functions and tasks of FTAP according to Article 3 of the Regulations issued together with Decision 2371/QD-BCT in 2022 are as follows:

- FTAP has the function of providing and exchanging information and data and supporting state management agencies, organizations, and individuals in accordance with the provisions of law on issues related to FTAs that Vietnam participates in in the Internet environment.

- FTAP has the following tasks:

+ Provide online lookup tools for commitments of all FTAs that Vietnam participates in, including commitments on taxes, rules of origin, services, and investment, and update the content of FTAs and trade agreements that Vietnam participates in.

+ Provide information to support the business's trading process, such as the domestic and foreign market situation, regulations on import and export of Vietnam and partner countries, trade defense, labor, environment, sustainable development, intellectual property, etc.

+ Update legal documents related to FTAs and trade agreements that Vietnam participates in.

+ Update the implementation of FTAs and trade agreements that Vietnam participates in.

+ Connect with information portals of ministries, branches, Vietnamese representative agencies abroad, local management agencies, and websites of associations... to facilitate access to information and support for people, businesses, and investors while enhancing the sharing and exploitation of shared data.

+ Provide and share digital publications and online training courses on FTA-related content.

+ Other contents related to FTAs and trade agreements that Vietnam participates in.

3. Regulations on information content provided on FTAP in Vietnam

According to Article 7 of the Regulations issued with Decision 2371/QD-BCT in 2022, the information provided on FTAP is implemented in accordance with the provisions of the Press Law 2016, the Law on Information Technology 2006, and other legal documents of the State. As follows:

- News section

Related news on the status of negotiations and implementation of Vietnam's commitments in FTAs and trade agreements that Vietnam participates in, import-export situation, trade promotion, trade defense, sustainable development, investment, agriculture..., information on new regulations and legal documents related to the implementation of newly issued FTAs and other related news.

- Update policy

Regulations and legal documents related to the implementation of commitments or related to Vietnam's commitments in FTAs and trade agreements in which Vietnam participates.

- Statistics, providing data and information

+ Data and information on export, import, and investment markets, including import, export, and investment markets,...

+ Data and information on the implementation of Vietnam's commitments in FTAs and trade agreements it has joined.

+ General report

+ Other information and data

- Other information
