According to Clause 2, Article 2 of Decree 06/2021/ND-CP, construction management means the act of management of entities participating in construction activities under the provisions of Decree 06/2021/ND-CP and other relevant laws in order to ensure conformance to safety, quality and progress requirements, effectiveness and meet design requirements and stated objectives.
Management of construction works in Vietnam includes:
- Construction quality management;
- Construction progress management;
- Construction quantity management;
- Occupational safety and environmental control;
- Occupational safety and environmental control;
- Management of other matters or issues that is prescribed in construction contracts.
(Clause 1, Article 10 of Decree 06/2021/ND-CP)
Pursuant to Article 11 of Decree 06/2021/ND-CP, the sequence of tasks involved in the management of construction works is regulated as follows:
- Land acquisition; construction site management.
- Management of building materials, products, components and equipment used in the construction project.
- Management of the contractor’s construction works.
- Supervision of construction works undertaken by the investor; inspection and pre-commissioning testing of construction works during the construction process.
- Author's supervision carried out by design contractors during the construction process.
- Controlled experiment, testing of the bearing capacity of the construction structure and construction verification during the construction process.
- Pre-commissioning testing at the construction stage, or the construction project constituent (if any).
- Pre-commissioning testing of completed construction items or works before being put into operation or in use.
- Inspection of the pre-commissioning testing conducted by the competent state authority (if any).
- Preparation and archiving of project completion documentation.
- Post-construction restoration.
- Transfer.
Basic principles of construction investment activities include:
- Ensure the compliance of work construction investment with master plans and designs, landscape and environmental protection, the suitability to natural and social conditions and cultural characteristics of each locality; ensure the stable life of people; combine socio-economic development with national defense and security, disaster preparedness and management, and response to climate change.
- Rationally using resources and natural resources in project areas, ensuring proper purposes, proper subjects and process of construction investment.
- Complying with standards and technical regulations, regulations on the use of building materials; ensuring convenient and safe access for people with disabilities, the elderly and children to public facilities and high-rises; ensuring scientific and technological application and information system application to construction investment activities.
- Ensuring the quality, schedule and safety of works, human lives and health and property; fire and explosion prevention and fighting; and environmental protection.
- Ensuring synchronous construction within each work and synchronism with technical and social infrastructure facilities.
-Organizations and individuals involved in construction activities must satisfy capacity requirements and assume responsibility for quality of works performed as prescribed by this Law.
- Ensuring the publicity, transparency, thrift and efficiency; preventing and combating corruption, waste, loss and other negative practices in construction investment activities.
- Clearly define the function of state management in construction investment activities from the function of management of investment decision makers, project owners suitable to each type of used funding sources.
- When formulating and implementing construction planning, performing construction investment activities, managing and operating construction works, and developing building materials, technical and management solutions must be adopted to ensure thrift and efficient use of energy and natural resources, and environmental protection.
