Regarding this issue, LawNet would like to answer as follows:
According to Clause 2, Article 58 of the Law on Road Traffic 2008, when operating a vehicle, the driver shall carry the following papers:
- Vehicle registration paper;
- Driver license, for motor vehicle operators defined in Article 59 of the Law on Road Traffic 2008;
- Technical safety and environmental protection inspection certificate, for motor vehicles prescribed in Article 55 of the Law on Road Traffic 2008;
- Motor vehicle owner civil liability insurance certificate.
Pursuant to Clause 4, Article 7 of Decree 10/2020/ND-CP, when transporting passengers, besides bringing the documents required by the Law on Road Traffic 2008, drivers must:
- Bring the physical transport contract signed by the passenger automobile rental business (unless otherwise provided for in Point c herein);
- Bring the passenger list bearing a mark of confirmation from the passenger automobile rental business (unless otherwise provided for in Point c herein);
- If the electronic contract is used, the driver must be equipped with a device capable of accessing the contract and enclosed passenger list provided by the passenger automobile rental business;
- Drivers serving funerals and weddings are exempt from the regulations in Points a, b and c, Clause 4, Article 7 of Decree 10/2020/ND-CP.
Clause 9, Article 9 of Decree 10/2020/ND-CP stipulates that when transporting cargo, in addition to the documents specified in Section 1, driver need to bring the following documents:
When transporting cargo, the driver must bring the physical transport order or a device capable of showing the transport order’s contents and other documents related to the driver and the automobile required by law. Transport businesses and their drivers shall not transport cargo exceeding the permitted weight.
- In urban centers, the construction of working offices, schools, hospitals, trade and service centers, cultural centers and residential quarters must include the construction of parking lots suitable to the works’ sizes.
- Car terminals, parking lots and roadside service stations must be built according to plannings already approved by competent state agencies, and must ensure technical standards.
- Toll stations, where tolls for vehicles operating on the roads are collected, shall be built according to plannings or investment projects approved by competent sate agencies. Toll stations’ operations must ensure uninterrupted and safe traffic.
- Vehicle mass inspection stations, where road administration agencies collect information on, analyze and assess the impacts of vehicle mass and size limits on road safety; inspect and handle violations of vehicles with sizes and mass in excess of the permitted size limits of roads, and caterpillars traveling on roads, shall be built according to a master plan elaborated by the Ministry of Transport and approved by the Prime Minister.
In case of necessity to protect road infrastructure facilities, the Minister of Transport shall decide on setting up temporary vehicle mass inspection stations.
- The Minister of Transport shall issue regulations on technical specifications of car terminals, parking lots, roadside service stations, toll stations and vehicle mass inspection stations; and on the organization and operation of toll stations and vehicle mass inspection stations.
